The act of inspection of living conditions is drawn up by competent persons in order to study living conditions. The list of persons responsible for drawing up the act, the information that is reflected there, is determined by the regulatory acts, according to which the survey is conducted.
Normative regulation
Directly in the laws there is no mention of the preparation of an act of inspection of living conditions. This issue is resolved at the level of ministries and central authorities (agencies, services, etc.). The form of the act and its content are approved by order of the head of the relevant service.
In 2009, the Ministry of Education issued Order No. 334, which regulates the procedure and recording the results of the inspection of the home where minors and their family members and citizens who want to adopt or take custody of children live.
The Ministry of Internal Affairs approved the instructions for units responsible for working with minors in Appendix No. 1. The act is drawn up if the child has committed a violation, the investigation is the responsibility of the police.
The sample of filling in the acts of inspection of living conditions by police officers shows that they collect less information.
Reasons for writing a document
The order of the Minister of Education lists the grounds for drawing up an act of inspection of living conditions. A similar document is drawn up when solving a dispute to a court regarding the rights to a child, his place of residence. These are cases where parents:
- have died;
- limited or deprived of their rights;
- evade duties in relation to the child;
- create conditions that impede the normal development of the child, or pose a threat to his life;
- There is a refusal to pick up a child from an educational or medical organization.
What circumstances pay attention
The reason for studying the living conditions of the child is the behavior and appearance of the child (aggressive behavior, lack of suitable, neat clothes). Injury to the child is a separate basis. The task of social services is to find out the causes of the incident and to determine the nature of the damage (whether one of the parents or guardians did it).
Change of residence. Guardianship authorities study the place of the new, alleged residence of the child and decide whether they are getting worse.
The check is carried out upon receipt of information by the police or the prosecutor's office about a child committing an offense. Its source is the appeal of citizens or information received by employees of these bodies in the course of fulfilling their duties.
If the question is raised about the return of the child to the family from which he was taken to the shelter, a new act of examination of living conditions is drawn up.
Who is the document
The act of examining the living conditions of the family is drawn up by a commission consisting of employees: guardianship authorities, the school where the child is trained, including those where children can live on an ongoing basis. Guardianship authorities may delegate authority to identify children who are left unattended by parents to specialized organizations.
Police involvement is necessary if there is a risk of violence from residents of the home. Therefore, almost always a policeman is present on the commission, regardless of whether the inspection is carried out at the initiative of the police or guardianship authorities.
The composition of the commission is formed by order of the head of the organization, a responsible person is appointed, a sample of the act of inspection of living conditions is being prepared.
Introductory part of the act
The following paragraphs are included in the introductory part of the act:
- date and place of the survey;
- FULL NAME. and the positions of service employees who performed it;
- birth certificate or passport of the child;
- place of registration of residence (address);
- place of real or actual residence.
Parent Information
- surname, name, patronymic, place of birth;
- place of registration and actual residence;
- information about the place and mode of work, contacts of officials from the place of work;
The listed information is entered about both parents.
In relation to each of the parents, it turns out: the degree of affection of the child to each of them, whether they live with him or separately. What influence do parents have on the child, is he obedient to him. Are parents able to provide basic needs (for housing, food, care, clothing, medical care).
In the sample act of the inspection of the living conditions of the family there is a clause on the registration of the marriage of the parents of the child.
Baby information
The health status of the child. How does the appearance correspond to age. Are there any diseases and special needs for medical support, medicines. Are there signs of physical and mental abuse of the child.
Appearance: the level of hygiene, whether there are quality clothes, shoes, whether they correspond to the gender and age of the child.
The level of adequacy of behavior in various situations is assessed whether there are developed communication skills with other people.
Parenting and education
In what educational institutions does the child study, is he enrolled in additional circles. The degree of success in the development of training programs. How much the sleep and nutrition regimen meets the needs of the child. How is the child's leisure activities organized and is there a developmental environment.
Information of persons living with a child
- F. I. O., year of birth, degree of relationship with the child;
- participates or does not participate in raising a child;
- assesses the relationship between family members, values, lifestyle, social circle of parents and children;
- who provides actual care or supervision.
Housing and Income Status
Information about the house, its area, sanitary and hygienic condition, the child’s own room, toys, books, a place for classes, etc.
Sources of income - social benefits, salary, etc. Does the child have his own property (real estate or a share in it is especially noted).
Other information
Members of the commission are obliged, in addition to fixing the living conditions and the level of material support, are obliged to conduct a conversation with family members, with the child. It is advisable to talk with other people who are familiar with the situation in the family (in particular, neighbors, relatives, close friends, etc.). The results of the polls are noted in the act.

- whether there are threats to life and health from the side of the parents or guardians or one of them;
- whether parental care is provided for both parents or guardians or one of them;
- whether the child and his family need help (social, material, advisory);
- forms of protection applied (consultations, placement in a shelter or other organization on an ongoing or temporary basis);
- decoding of the surname, name, patronymic of the person responsible for filling out the act of inspection of living conditions;
- place for signature and stamp of the head of the organization responsible for approving the act.
Compilation procedure
If the act is drawn up by an employee of the guardianship authorities, then 3 days are given from the moment of the inspection. If the compiler is an employee of another organization, the copy is sent to the guardianship authorities, the copy remains in this organization.
Another copy must be sent to the child's parents. The law gives the right to appeal in court. The consideration of cases is provided as part of the civil process.The position of the Armed Forces of the Russian Federation is interesting: the small incomes of parents do not give reason to conclude that the parents are insolvent to provide care for the child.
