The driver’s profession is one of the most common in the modern world. In essence, driver outstaffing is the rental of an employee who has the right to drive the necessary category of vehicles for a certain time at a special agency that provides such services. Registration of labor relations is not accompanied by this process. It will only be necessary to formalize a contractual relationship with the person providing the workers for rent.

A similar experience existed in the USA already in the eighties and nineties of the XX century and was expressed by the activities of companies such as Manpower and the like. Another thing is that the labor market requires more and more qualified and experienced workers.

Through the prism of OKVED (economic classifier of types of economic activity), driver outstaffing is the provision of employment services and has the number 74.50.01.

Thus, legal entities and individual entrepreneurs who have registered the implementation of this type of activity can engage in such activities.

In addition, persons providing driver outstaffing services are required to undergo a special accreditation procedure and have a registered capital of at least 1 million rubles.

The issue of banning outstaffing since 2016 has been widely discussed. However, in fact, this is not about a ban on the provision of labor, but about significant restrictions on such relations. The main goal of the restrictions is to prevent enterprises from “expanding” and not paying more taxes, “masking” part of the staff as temporary wage workers. All the nuances of these restrictions are indicated in the Labor Code of the Russian Federation.

As a rule, together with the driver, the customer is provided with the vehicle necessary for transportation.

Thus, people engaged in outstaffing, provide work for drivers of vehicles, satisfy the needs of enterprises in temporary transport services, and also profit from their activities.

Enterprises only benefit from such a solution to the personnel issue. By concluding an agreement with the agency, they solve the issue of temporary need for driver services and do not undertake the registration of labor relations with the employee. Accordingly, it is not necessary to pay the driver vacation, sick leave and other expenses.

Without accepting an employee, enterprises have the opportunity to remain small or medium, taking advantage of significant benefits provided by law, for example, a simplified taxation system and a temporary restriction on the conduct of scheduled inspections of small and medium-sized businesses.

It is also not necessary to organize pre-trip and post-trip medical examinations of the driver, involving the appropriate medical personnel. And also to decide on the technical condition of the vehicle, repair it, conduct technical inspections and so on.

If the organization has a car, but no driver, then the terms of the contract with the agency may provide exclusively for the rental of the driver without providing a vehicle.

This option is ideal for drivers who do not want to burden themselves with the constant search for a customer. All their functionality is reduced directly to the work of the driver. The agency takes care of all financial and organizational matters, providing the client with a ready-made work front.

Thus, working in a large company engaged in transport outsourcing gives the driver such advantages as the presence of a working car and constant orders without the expense of energy to search for them.

The main and only minus is that the driver does not work for himself, but for "uncle", who takes away a percentage of the deal.
