Mandatory document
The license for garbage removal is a binding document that allows carrying out activities for the transport of solid waste to landfills. Since 2016, a law has been in force in our country that obliges an enterprise transporting garbage to obtain a license. Not so long ago, such documentation was required only for landfills and other waste disposal sites. In 2018, waste will be disposed of according to the rules that were established earlier.

What activities are subject to licensing?
In accordance with paragraphs 2 and 3 of the Federal Law No. 458, licensing of waste disposal is carried out along with other types of activities:
- sorting, cleaning and preparing waste for recycling;
- collection of solid municipal and household waste;
- processing or disposal of MSW and MSW;
- neutralization;
- full or partial reuse of garbage;
- accumulation and storage.
Each of these types of activities has a separate licensing, and in its absence, the functioning of the organization or individual entrepreneur is illegal. In this case, the license for garbage collection must be obtained separately for each type. License conditions and requirements
Do I need a garbage disposal license? This is a common question. In addition, you will need permission from local authorities and a clear understanding of those regulatory documents that govern the collection, collection, storage of household waste. To get a license for garbage removal, you need to go through several stages:
- register as an individual entrepreneur;
- activate a current account at a banking institution;
- choose an affordable and convenient taxation system;
- to get permission.
In order to fulfill the last point, it is necessary to obtain a permit for activities with waste in Rospotrebnadzor. After this, the control regime for the export of industrial and consumer waste is agreed upon, and the required documentation must also be collected.
What documents will be needed?
To obtain a garbage disposal license, a sanitary and epidemiological conclusion is required on the compliance with the rules and standards of buildings, structures, devices, mechanisms that will be used in the treatment of MSW and MSW. This is a prerequisite for those who require permission to transport garbage. In addition, the following documents must be submitted:
- an application that is executed in accordance with the requirements;
- certificate of state registration of IP (its copy);
- copies of constituent documents;
- confirmation of payment of a license fee;
- in the form of acts, the presence of all mechanisms, equipment and buildings that are needed to carry out this activity is listed;
- copy of certificate of registration of IP with the tax inspection;
- duplicate labor contracts that are concluded with employees who have access to work at an enterprise of this type (they can service waste with a hazard from 1 to 4 classes).

Be sure to include the following information:
- the name of the potential applicant and his address;
- the coordinates of the territory in which the declared services will be provided;
- registration certificate data and identification codes;
- specific type of activity;
- a list of wastes together with the FWCC codes and the name by class;
- a positive verdict of the sanitary service and its confirmation with a date not earlier than July 1, 2015;
- confirmation of payment of state duty;
- Email and phone numbers.
Where are the documents submitted?
The documentation for obtaining a license for garbage collection must be sent to the licensing authority to the place where the individual entrepreneur (or legal address of the company) was registered, five days after sending the request. Consideration and adoption of a negative or positive verdict usually ranges from 60 to 90 days. Who issues a waste disposal license
Under Russian law, all organizations involved in the transportation of solid waste and solid waste were required to obtain a license before July 1, 2017. Enterprises may express a desire to engage in this activity and later than the deadline. To obtain permission, you must submit a request to the licensing authority at the place of registration of the organization.
The entire package of documents is considered by the Federal Service for Supervision of Natural Resources.
An enterprise can receive both a positive resolution and a negative, substantiated answer.
Any changes in the organization's activities (changing the class of waste, location or destination of transportation) should not be kept secret. The enterprise is obliged to notify the issuing authority within 14 days from the moment of any important transformations. Notification is made in writing.
Licensing of the enterprise indicates that it fully complies with all standards approved at the state level. The organization has the necessary technical base for the safe delivery of waste to the place of further location.
During the entire period of the license, the carrier is regularly inspected by government services. This usually does not occur more than once in a calendar year.
If the location of the facilities or the class of the waste has changed after the license was issued, the entrepreneur must notify in writing the appropriate licensing authority within two weeks.
Scheduled inspections, as already noted, are carried out once a year. Notifications about them are sent to the entrepreneur ten days in advance. The time for conducting control operations should not be more than one month. Then, the results are written in writing in a special act with all signatures of the participants of this commission. The disagreement of the licensee with its conclusions can also be reflected in this act. If the IP does not eliminate the discovered violations within the prescribed time, the licensing authority has the right to suspend the permit or file a lawsuit in the court to revoke the permit. Upon liquidation of the institution that issued the license, the latter shall lose its force. In addition, it can be canceled without consideration in court, if the license fee has not been paid within three months.
Cost of a garbage disposal license
The document is valid for five years.When the specified period ends, if all the rules are followed and the documentation is submitted again, you can extend it indefinitely if the applicant performs only the activity that is confirmed by permission. Its price is approximately 300,000 rubles. If sanitary rules and norms are not respected, then an administrative penalty is imposed in the form of a fine (for private entrepreneurs - about 50,000 rubles with suspension of operation for up to 90 days, and for officials - from 10 to 30,000 rubles). The fine of a legal organization is up to 200,000 with the suspension of its activities for three months.
Renewal
In accordance with the law, the license obtained has no expiration date, and it does not need to be renewed after a certain time period. But the sanitary-epidemiological authorities and Rosprirodnadzor regularly check to determine if the licensee is complying with the requirements. If violations or legislative changes are identified, a license is again required.
Serious violations of the licensee are:
- admission to activities with waste, transportation, collection and processing of those who do not have training and the necessary certificates;
- use of the facility (transport, equipment or premises) with deviations from those instructions that have received a positive verdict from the state environmental review; very bad if the use of such objects caused negative consequences for nature;
- transportation, collection and other actions that are carried out without observing epidemiological and sanitary requirements, as well as non-compliance with environmental requirements.
Territorial specifics of obtaining a garbage disposal license
It should be noted that the geographical location of the company, which is engaged in the transportation and collection of waste, is determined by those who issued the license. For example, if the federal or regional body provides it with an executive branch, the organization can operate throughout the country. If the license was obtained from a regional authority, it is also possible to work outside this region, however, a mandatory preliminary warning in writing is required, which is sent to the licensing structure of another region.
What is indicated in writing for activities in another region?
It indicates the following information:
- full or abbreviated name of the company for legal entities, location and legal form;
- registration number on the establishment of a legal entity and information of a document that confirms the inclusion of the organization in the unified register of legal entities;
- An individual entrepreneur makes a full name, passport details, place of residence, registration number of the record of his registration, information about the document that confirms his entry in the state register. Also, a certified duplicate of the license is attached to the executed document.
