Today we will be interested in petty theft. This crime occurs quite often. It doesn’t matter in which country this happens. Everywhere for a committed act punishment follows. So, for example, in Russia and Ukraine administrative responsibility is laid for this. It manifests itself in many forms. What can be expected for petty theft? What to prepare for by committing this crime? Is everything really dangerous?
What is it
It is necessary to clearly understand what kind of process is involved. What is theft? And when is it recognized as small, insignificant? Indeed, in some cases, people are tried for theft, robbery, robbery, and so on. If you look at the definition, then all these acts are designated as theft. But in different shapes, sizes and degrees.
Theft is an unlawful seizure of another's property, committed with intent. It can manifest in various forms. For example, in the form of robbery, theft, robbery, fraud, looting. Or maybe it is an independent process, which usually characterizes petty theft.
When it is considered
But how to determine which crime was committed? The thing is that this act has a certain “value”, that is, the amount recognized by the court as small. In such a situation, it can be assumed that the unlawful seizure of property on a small scale was committed.
But what exactly is the value in question? In what case is an illegal act qualified as petty theft? The amount of damage in this offense does not exceed 1000 rubles. This is the rule that applies in the Russian Federation. In Ukraine, this is 0.2% of the minimum wage. True, in Russia at the moment a certain "rise in price" of the crime is being discussed. And it is proposed to set the bar at 5,000 rubles. Not the best option, but it has not yet been adopted. And it is not known whether such a decision will enter into legal force.
Ukraine
The article "Petty theft", as already mentioned, takes place both in Russian legislation and in Ukrainian. Preventive measures in one case or another are similar. What can be said about Ukraine?
For example, petty theft in a single repetition (that is, once for the entire time) is not punished too severely. Typically, the offender is issued a kind of penalty, expressed in the form of several minimum wages. That is the minimum wage. How much will you have to pay? The court will establish, but in the range of 3 to 10, the so-called minimum wage. An impressive amount for petty theft. But this is not a criminal liability. In fact, you can pay money for your freedom, and all problems will be resolved.
With addition
What's next? Now it is worth paying attention to several more measures to prevent this crime. For petty theft in Ukraine, you can get off with the most common corrections. But with a little addition. In reality, not a very serious preventive measure. And it is used not so often.
Correctional work in this case cannot exceed 1 month. At the same time, a peculiar fine of 20% of the salary is recovered from the culprit. Russia also has similar measures. And they are common. But more on that later. Indeed, in Ukraine there are other forms of combating criminals in the event of unlawful seizure of another's property.
Arrests
For example, there are arrests. They are administrative. In simple terms, the offender is put in a “monkey” for a certain period to punish. And give time to think about your behavior.
Honestly, the measure is very common. But the term of the arrest is not impressive.Indeed, in Ukraine only 5-10 days of imprisonment are laid for such an act. Not too much if you think about it. However, when the crime is committed only for the first time, such a measure takes place.
Multiplicity
But multiple petty theft is already more seriously punished. The difference is not too noticeable, but obvious. For example, everything will also be charged a violator. With repeated administrative convictions or the commission of a petty theft, you will have to pay up to 50 minimum wages.
Instead of this measure, the use of correctional labor with a small fine is not excluded. You will have to work 1-2 months (the exact term is assigned depending on the specific case), and pay - 20% of the earnings. In the same way as in the previous case.
Administrative arrest also takes place. It is increasing, but slightly. And now it is 10-15 days in general. These are the penalties provided for in Ukraine for petty theft of another's property. And what does Russia rely on?
Russia
In this regard, everything is much simpler. The thing is, for fraud or petty theft, according to modern laws, the country provides for administrative liability. It is often expressed as a fine. And our case is far from an exception.
Petty theft (Administrative Code, Article 7.27) will be punished by payments to the state treasury. And it will be no more than 5 times the size of the stolen property. But at the same time there is also a minimum. And he is 1000 rubles. That is, for petty theft you can pay from one thousand Russian rubles, and then be free. Humane punishment. Especially when you consider that small thefts themselves are rare. In Russia, there are more serious forms of illegal seizure of other people's property.
Games with freedom
Restriction of freedom also takes place. In the same way as in Ukraine. This preventive measure is expressed in the form of a so-called administrative arrest. The offender is given time to think about behavior and a chance for correction. No fines or other monetary penalties are provided for in this scenario.
How many violators have the right to imprison? The term is set individually. But at the same time, it cannot exceed 15 days. Most often it is the maximum administrative arrest that will be imposed in proceedings. Such a measure is actively used in Russia whenever possible.
Practice
How are things really? In reality, violators are not always sentenced to punishment under the law. Most often, small theft of property is accompanied by aggravating circumstances. And they are just able to "diversify" the sentence to the guilty.
For example, the robber will not only have to endure fines and arrests, but also compensate the moral and material damage to the victim. A common case, especially when it comes to the primary crime.
In addition, very often people simply do not declare petty thefts and try to figure it out all by themselves either amicably, or with the help of fists. This is especially true in situations where someone close to you is found guilty. Doing so is not recommended. Otherwise, you can become the culprit under the article "Beatings" or something like that. If you do not want to apply to the law enforcement authorities with the appropriate statement, you can try to talk with the criminal and solve everything in words. But not in the fists. It is preferable, of course, to do everything according to the law.
As you can see, there is no special difference in punishments in Ukraine and Russia for petty theft. This is far from the most dangerous crime, therefore, no serious preventive measures are used. In general, as already mentioned, the articles provide only for crime in its purest form. Without aggravating circumstances. If there are any, penalties are tightened.
