Holidays: types and concepts

Holidays are currently available on various occasions. So, for vacation and restoration of health, annual paid vacations are provided. It is important to add that today there are certain types of annual paid leave, which includes both primary and secondary. In addition, leave should be allocated for family reasons, for health reasons and so on. It would be advisable to consider each of the existing categories separately today.

It is necessary to add that in the first year of activity in the organization, this period is reduced to six months.

  • Prosecutors and judges are expected to vacation for 30-48 days.
  • Candidates and doctors of sciences are given 36 and 48 days of rest.

In this chapter, it will be appropriate to consider the essence and types of additional holidays. So, paid vacation of an additional nature today is provided annually in accordance with Article 116 of the Labor Code to the following categories of persons:

  • Employees of organizations engaged in activities with dangerous or harmful working conditions.
  • Employees of structures that work in the Far North. It is necessary to add that this also includes areas that are equated with them.
  • Employees of organizations whose working day is considered non-standard.

It is important to add that at present, in addition to the above, there are other cases of granting additional leave stipulated by the current Labor Code, as well as other federal laws.

You need to know that the duration of an additional vacation (by the way, the main one also applies here) is determined in calendar days. In addition, in this case, the maximum limits are not set by the Labor Code. It is important to emphasize that additional leave (both paid and unpaid) is also provided to employees of organizations when they are sent for training.

It should be borne in mind that today study leave is intended for employees of various structures on the basis of a certificate-call from an educational institution in accordance with the requirements of chapter 26 of the Labor Code. It would be advisable to consider this issue in more detail. Among the cases when the employee is paid the average wage during the vacation, the following should be highlighted:

  • If an employee is studying at a university that has state accreditation in accordance with correspondence and evening (full-time) forms of training, then he is provided with 40 calendar days of vacation (when passing certification of an intermediate nature (exams, tests) on the 1st and 2nd courses), 50 calendar days of leave (applies to each of the following years of study), 4 calendar months of leave (in order to prepare and subsequently protect the work of the final qualification plan, as well as passing the final state exams) or one month leave according to the calendar (for the delivery of final state exams).
  • If an employee is studying in a secondary vocational education institution by correspondence or evening education, then the periods presented in the previous paragraph correspond to the following numbers: 30, 40 calendar days, 2 and 1 month.
  • If an employee is successfully trained in the educational structure of primary education of a professional plan that has state accreditation, then he is given 30 calendar days of leave during the year in order to pass exams.
  • If an employee is studying in an evening institution of a general educational character that has state accreditation, then he is given 9 days to leave for graduation exams in the ninth grade and 22 days in the eleventh grade as a vacation.

Holidays without pay

You need to know that vacation, subject to the exclusion of salary, is granted to an employee of the organization in accordance with his written application if there are certain reasons of a respectful nature. The duration of such leave is set strictly by agreement of the employer and employee. It should be emphasized that the employer in any case agrees to provide vacation, subject to the exclusion of salary preservation, to the following categories of employees:

  • Up to 35 calendar days per year for participants of the Second World War.
  • Up to 14 calendar days per year for old-age pensioners engaged in labor activities.
  • Up to 14 calendar days per year for husbands (wives) and parents of military personnel who died or died due to shell shock, injury or mutilation, which was received in the process of performing military duties, or due to illness related to military service.
  • Up to 60 calendar days per year for working disabled people.
  • Up to 5 calendar days per year for employees of organizations upon registration of marriage, the birth of a child or the death of loved ones.
  • In other cases that are provided for by the collective agreement or federal laws of the Russian Federation.

The right to maternity leave is established by Article 255 of the Labor Code in force in Russia. It is provided to women in accordance with the place of work upon presentation of a sick leave, which can be obtained at the antenatal clinic for a period of 30 weeks (with multiple births - 28 weeks) of pregnancy. One way or another, the total number of vacation days (postpartum and prenatal) is indicated on the temporary disability sheet. So, the duration of maternity leave is currently as follows:

  • In the case of normal childbirth, 70 days are given before them, as well as 70 days of leave after in accordance with the calendar.
  • In case of complicated delivery - 80 days before delivery and 86 days of leave after them in accordance with the calendar.
  • In the event of the birth of more than one child, 84 days before delivery and 110 days of leave after them are provided.

According to article 256 of the Labor Code in force on the territory of the Russian Federation, upon the application of the employee, she must be granted leave to care for a child up to three years. It is relevant only after the end of maternity leave and pregnancy. It can be used both in parts and completely by the grandfather, grandmother or father of the child, as well as by another relative or guardian who actually cares for the baby.
