In accordance with the laws of our country, every citizen can apply for retirement benefits. Some people have the right to retire on a well-deserved rest on special grounds in view of their labor activities related to the performance of important functions for the state. This category includes federal government officials. Long-service pension is one of the supplementary benefits paid to former civil servants. Let's try to figure out what kind of financial support from the state officials can apply for.

Pension payments to civil servants

The allowance can only be assigned to those citizens who have been working in the federal service for a long time. Moreover, the size of the pension payment is determined by the length of service directly in the public service.

The special status of this manual is determined by three legislative acts. The possibility of receiving monthly payments is fixed in federal regulatory legal acts regulating the issues of state pension provision in the Russian Federation and passing the civil service.

We are talking about Russian citizens who are engaged in professional activities, being at the post of a federal institution and passing public service. Federal civil servants do not receive wages, but monetary allowances from the national budget.

At the same time, it is important to separate the concept of “public sector employee” from the category of “civil servant”. Not every state employee has the rights of a federal civil servant. Such are considered only persons endowed with power and administrative powers and managerial functions. Civil servants are employees of executive structures. Everything related to the status of officials and the specifics of passing the civil service is reflected in Federal Law No. 79.

Conditions for applying for social benefits

Citizens who are faced with certain conditions that are not dependent on them can apply for retirement benefits. So, for example, a pension is prescribed for disability, reaching a working age, and when death occurs, a relative of the deceased can receive the benefit. Long service pension is paid to a federal civil servant only if he meets several conditions at the same time:

  • length of service in the civil service is more than 16 years;
  • at the time of applying for the establishment of a pension, the official is not officially employed, that is, he can apply for benefits only after resignation.

Moreover, the following circumstances may be grounds for dismissal of a civil servant:

  • reduction in the number of employees or liquidation of the state structure;
  • termination by a person of his authority;
  • achieving an age at which the law does not provide for the possibility of a person occupying government posts;
  • poor health conditions that impede further service;
  • own desire of an official who has reached a working age.

Persons who have worked for at least a year in the positions of the federal civil service right before the planned retirement for a well-deserved rest have the right to apply for a pension. This rule does not apply to persons dismissed during the reorganization or liquidation of the federal structure or as a result of a reduction in the number of employees (Federal Law 166, Article 7, Clause 3).

Age limit increase

Very relevant is the question of what age is the limit for civil servants. Back in May 2016, the Government of the Russian Federation decided to increase the retirement age limits for officials. Starting in 2017, for men and women involved in public service, the moment of retirement will be delayed for six months. If, until 2017, women went on well-deserved rest at 55, and men at 60, now now every year this figure is increasing by six months.

Increasing the age at which a civil servant has the right to retire will not occur immediately, but in stages. The government has proposed a gradual increase scheme in order for the population to adapt to the reform. It is planned that for men the maximum values ​​will be reached by 2026. Then civil servants will retire at the age of 65. For women, the promotion period will be extended for another six years. Thus, after 2032, officials will retire at the age of 63.

In Federal Law 166, which determines the procedure for pension provision, amendments have also been made to the appointment of benefits for long service. According to the previous law, an official had to work at least 15 years in state structures. Today, for awarding a seniority pension to federal civil servants, it is necessary to have at least 16 years of professional experience, and by 2026 this figure will reach 20 years.

The decision of the Government to increase the retirement age is well-founded. According to experts, such a reform allows:

  • retain qualified personnel - due to the reduction in the number of able-bodied people, which occurs annually, it is difficult to find a full-fledged replacement for employees with many years of experience;
  • significantly save budget funds.

Not so long ago, following the changes regarding the moment of incapacity for work for civil servants, amendments to the legislation on state pension provision in the Russian Federation for other citizens were adopted. This issue caused a wide public outcry. It was discussed for a long time to what level it is preferable to carry out an increase and whether it is worth making the retirement age the same for both sexes, but still a decision was made to synchronously increase this indicator (for both men and women) by five years. The changes will take effect next year.

How pension is calculated for officials

The size of state benefits for all categories of federal public servants is established by the above law. The normative legal act notes the possibility of awarding payments for the development of years. After the amendments related to increasing the age of citizens, the clause on the appointment of a pension for length of service is not excluded. Former officials may still qualify for a premium.

According to Federal Law 166, benefits are calculated according to a certain scheme. Previously, it was installed for citizens, if the experience of their service exceeded 15 years. Now the premium is due to persons who have held the post of civil service for 16 years, no less. The amount of benefits depends on the average monthly salary of a federal civil servant.

When calculating, 45% of the average salary are taken as the basis, from which fixed insurance contributions are calculated, which are compulsory in accordance with the law of Russia “On insurance pensions”.The amount of payments for processing is increased by 3% of the average monthly salary for each year after 16 years spent in the service.

Rules for calculating seniority

A federal civil servant will only be able to become a candidate for a seniority pension if he has a certain length of service. The total length of periods of activity in government agencies is counted. It may not be continuous, the main thing is that when adding up all the time periods during which a person has held a position in the civil service, is 16 years.

To assign a pension for seniority, it is necessary that the seniority of the civil service include all stages of labor activity at the posts of the federal civilian civil service and other positions determined by the Decree of the President of the Russian Federation. If, however, to establish the benefit provided by the legislation on pension provision, there is not enough experience, the stages of the implementation of other, no less useful activities for the company can be counted.

To find out the amount of social benefits for length of service, you must refer to article 14 of the above Federal Law. The formula for calculating the allowance, which is assigned in case of exceeding the minimum working experience of a citizen who has undergone public service, is as follows:

П = (45% х СЗ - СП) + 3% х СЗ х ВСт, where П is the pension size of a federal civil servant for exceeding the seniority, СЗ is the average monthly salary amount, СП is the amount of insurance premiums in case of loss of working ability and fixed payments, ВС - years of service in excess of the minimum 16 years as of 2018.

However, there are certain restrictions regarding the total amount of pension provision for former officials. It is not allowed that the allowance, which includes insurance pension, fixed payments, and length of service, exceed 75% of the average monthly salary of federal civil servants, which is determined by the relevant regulatory legal act. If the length of service is not enough to establish additional payments, the length of service is calculated on the basis of the average earnings for the last year of service.

As an example

For example, citizen Ivanov Ivan Ivanovich served as deputy chief in one of the structures of the Ministry of Internal Affairs of the Russian Federation. In June of this year, it was decided to establish him an old-age insurance pension. By the way, its size since May 1, 2018 is 11163 rubles. - This indicator is valid throughout Russia. Senior citizen Ivanov has been working for the full 26 years. On average, he monthly received at work 22 thousand rubles. To determine the length of service allowance, which is due to a former official, we use the formula proposed above.

So, the size of budgetary subsidies for civil servants cannot be less than 45% of the average monthly salary with the total addition of the stages of civil service and increases by 3% for each year over 16 years, but at the same time it cannot exceed 75% of the average salary. Ivanov worked over the norm for 10 years. His average monthly salary is 22 thousand rubles, and the insurance pension at the time of circulation is 11163 rubles. According to the above formula, we calculate the total allowance for the production of years:

P = (0.45 × 22000 - 11163) + 0.03 × 22000 × 10 = 5337 rubles.

This premium will be assigned to the insurance pension to citizen Ivanov. The total monthly allowance will be 16,500 rubles.

As well as any other social benefit, the state subsidy of pensioners for the length of service can be recounted. Subject to the appointment of a pension by a federal state civil servant or the transition from one form of security to another, it is necessary to recalculate the amount of benefit. For this, a citizen needs to write a corresponding application to the Pension Fund.And you can do this at any time, it does not matter how much time has passed since the moment this opportunity arose. There are no time limits for indexing insurance pensions and seniority benefits, unlike social disability benefits.

The amount of state subsidies to a pensioner for seniority is recounted in the following cases:

  • when changing the amount of insurance labor benefits (old age or disability);
  • with an increase in the length of service in the civil service;
  • with an increase in the volume of monetary content of officials at the federal level.

In other situations, a transition is made from one type of pension provision to another. In addition, government allowances for years worked beyond the norm are subject to centralized federal indexation in the manner established by the Government of Russia.

All citizens belonging to the categories of federal state civil servants for whom the insurance pension benefit is intended must work for more than 16 years in the relevant structures in order to be eligible to receive service allowance. The insurance period should include all periods of labor in the civil service. In addition, the legislation on insurance pensions stipulates the right of citizens who have reached a certain age to submit an application to the Pension Fund for awarding the share of insurance coverage established for the basic allowance for over-the-norm development based on the total coefficients. Recent indicators are individual. Coefficients are taken into account for not less than one year of service after assignment of a grant for length of service.

As noted above, after amending the legislation on the pension provision of civil servants, in 2018 women can apply for an insurance pension after reaching 56 years, and for men - 61 years.

The insurance period includes periods of service, including work taken into account when calculating the length of service for assigning subsidies, and the stages of other activities that are taken into account for assigning insurance benefits upon reaching the working age.

Registration of a pension for the length of service

Regardless of the class rank of a federal state civil servant, each official who has reached retirement age and has an impressive length of service can count on the grant of a service grant. At the same time, no time frame is established: every citizen holding a post in the civil service is not deprived of the opportunity to apply for this type of benefit from the moment the right to receive it has arisen.

An application with a request to establish an allowance for state insurance benefits addressed to the chairman of the territorial branch of the RF PF must be submitted to the organization located at the place of residence, or to the MFC. This can be done in person or through a representative if the latter has a notarized power of attorney. You can also send the application by mail. When mailing, the period for consideration of the application is counted from the date on the postal stamp. When submitting documents through “My Documents”, the countdown starts from the day the application is received by the specialist of the multifunctional center.

After the application is submitted to the Pension Fund, it is submitted to a leading specialist for consideration. The maximum time for consideration of an application under the regulations should not exceed ten calendar days from the date of application. In case of a positive decision on awarding a pension to a civil servant for seniority, the allowance is assigned from the first of the current month, but not earlier than the day from which the person acquired the right to additional subsidies.

What documents will be needed

The Federal Law on Civil Servants of the Russian Federation establishes a list of documents that must be submitted together with the application for the appointment of benefits for long service. These include:

  • original and photocopy of the passport of a citizen of the Russian Federation;
  • certificate of the average monthly salary of an official for the last year of service;
  • a certificate from the personnel department of the state agency in which the official was serving, indicating the position and the periods of labor included in the length of service, and the necessary premiums for exceeding the norm;
  • certificate of assignment of insurance pension coverage, indicating the amount of benefits;
  • copy and original of the work book;
  • copy and original of the order of dismissal from the state agency;
  • copy of military ID (including for women in military service);
  • other papers confirming the periods included in the length of service of the civil service.

The list of documents attached to the application for a pension to a civil servant may differ in the specific territorial branch of the RF PF.

Nuances when applying

The civil servant may submit the entire package of documents on awarding insurance pension or service subsidy directly to the Pension Fund department or transfer the paper to the personnel department of the state body in which he worked in a specific position. If the federal organization is reorganized or liquidated, the application and the attached documents must be transferred to the state agency to which the functions of the reorganized structure were transferred.

How to get a pension

For former officials, as well as ordinary citizens, pension payments are paid by the Pension Fund every month. The recipient has the right to independently choose the method of receipt or delivery of benefits. If a pensioner does not have the opportunity to receive a payment on his own, he can draw up a power of attorney to a notary to pay a pension to another person.

Methods for receiving and delivering retirement benefits that are available to former officials:

  • By mail - you can arrange delivery of benefits to your home or come for it yourself at the post office at the place of registration. A citizen is set a certain date of receipt of payment by mail at the place of registration. If you do not come for benefits for six months or more, then payments are suspended by the Pension Fund of the Russian Federation. In the future, you will have to write a statement to resume them.
  • A postman can bring a pension to his house according to the established numbers.
  • At the bank - a pensioner can choose a financial organization at his discretion. You can receive a pension at the bank's cash desk or withdraw money from the card through an ATM.
