Entering into an argument, people have different goals. Depending on the chosen goal and the task set, the dispute can take all kinds of forms and forms. It is customary to distinguish between three main types of dispute:
- apodictic - a dispute for the sake of establishing the truth (even ancient philosophers pointed out that truth is born in the dispute);
- eristic - for the sake of persuading the opponent to his point of view, his conviction;
- sophistic - a dispute for the sake of the dispute.
Trolling
There is one more vivid view of the modern dispute, which can hardly be called a dispute; rather, it is better to attribute it to the category of petty villainy (and petty?). This is trolling (found mainly on forums and other social sites on the Web).
A special case. Simply put, a “troll” on the Web is not a mythical Scandinavian creature (although they are compared with it), it’s a person who posts any messages that are provocative in nature (for absolutely any reason), rudely and brazenly, frankly interfering with public discussions, sometimes imposing a completely delusional point of view.
Often, trolls accompany their messages-provocations with vulgar expressions and insults. At first glance, you can give an assessment to such a person - inadequate, insane, or under a degree, which is one and the same. But no! Not so simple.
Trolling is a dangerous phenomenon. There are frequent cases when it is specially organized and well paid by the customer. For what? It’s easy to guess. One way or another, the “trolls” impose a special kind of debate. Words cannot be ejected from a song - since a phenomenon takes place, it means it must be added to the classification series.
Disputes can also be organized and spontaneous (often during meetings). Natural disputes cannot be classified as highly productive. What can not be said about organized. This form of controversy includes the debate of the parties. Organized disputes (debates) are prepared in advance, held in accordance with established rules and under someone else's guidance. Debate is an organized collective discussion of a topic, as a result of which a decision is required. Conducted clearly according to established rules. The intensity of the debate depends on the venue, the person managing this process, from calm and even to stormy, emotionally expressed, with the contents of the glass splashing into the opponent and his hair fragments torn out (notorious cases of political debate). A good example of a productive civilized dispute is the judicial debate.
Judicial debate
Judicial debate is a procedural action during a public trial. Providing each side of the process with the opportunity to deliver a speech, state their own opinion on what a fair decision should be, present their arguments and point out errors, inaccuracies and contradictions in the judgments of the other side. Calm productive dispute between the parties, without mutual insults and disrespect. Judicial debate excludes this.

In search engines, there are a large number of appeals with the request to submit a “debate sample”, or “is there a ready-made sample of a judicial debate?” There is no definite answer to this. On the one hand, each trial has its own characteristics. On the other hand, there are examples. These are excerpts from the wonderful speeches of the defenders (lawyers) who took part in the well-known debate. It will not be superfluous to get acquainted with them in preparation for the process.
The most important thing when participating in the debate is to observe a culture of dispute, to have a good command of the subject of discussion, to be able to convincingly state your arguments, focusing on specific facts. It is also important at the same time to consistently bring the participants in the debate to the final part of their own speech, from which the actually prepared draft of the desired judicial decision will flow. Correct motivation plays a significant role.
It is best to prepare your speech independently, in an arbitrary form, and not to memorize expressions that have already become winged in the legal world. The performance can be lengthy, with no time limit. Judicial debate provides for this. It is important that the information content is “in essence”, “on the topic”.
