A temporary residence permit, in abbreviated form, is an important paper that provides a foreign citizen with the right to reside in Russia for a certain time period. This type of document appeared in the migration legislation in 2002. Today, RVP for foreign citizens is an intermediate stage between temporary and permanent residence on the territory of the Russian Federation, and the next step after a temporary residence permit is a residence permit and citizenship of the Russian Federation.
RVP of a foreign citizen in the Russian Federation is required to receive all visitors, except for Belarusians and immigrants from other countries (and members of their families) who are highly qualified in the field of interest to the state.
A temporary residence permit is issued to a foreigner on the basis of a quota established annually by the Government of the Russian Federation for different categories of citizens and constituent entities of the Russian Federation. In 2017, the quota amounted to 110,880 people distributed between the entities. If the RVP is canceled, then the foreign resident has the right to receive documents either in another region of the Russian Federation, or in the same, but after a year.
Registration of a temporary residence permit
How to get RVP to a foreign citizen? To apply for a RVP, a foreigner must contact the FMS with a full package of documents. It is necessary to submit to the authorized bodies:
- the original and a copy of the completed application;
- two photos 3 by 4 cm in size (those applicants who at the time of filing the documents are not citizens of any other country must submit their three photos);
- paper, on the basis of which a foreign citizen has the right to be on the territory of Russia (such documents include, for example, a residence permit, registration or visa);
- foreign passport (the period of validity of the document at the time of application for temporary residence should not be less than three months).
Among the required documents listed above, the receipt of the paid state duty is not mentioned. The fact is that the procedure for paying for public services is not an obligation, but the right of a foreign citizen. In the case of payment, the contribution is registered in the treasury of the country, and important securities can be obtained by interagency request. If any permission documentation is drawn up in another language, then a translation of the document into Russian with notarization must be attached.
How to get a temporary residence permit
A temporary residence permit is issued at the FMS department at the place of application. A permit mark is placed in the alien's passport. A foreign citizen receiving RVP is issued in the form of a separate paper if the foreigner does not have citizenship. RVP is issued for three years. In the future, there is no way to extend the document, then you need to apply for a residence permit in the Russian Federation.
RVP after marriage
Obtaining a temporary residence permit with a certificate of marriage is a simplified version of the application for persons who are citizens of a state and foreigners without citizenship. In other words, the registration takes place without taking into account the quota on the RVP, which is set separately for each region of the Russian Federation.
To apply for a marriage in a marriage, a foreign citizen must comply with some conditions:
- legally, i.e.in the registry office to marry a citizen of the Russian Federation;
- spouse of a foreigner must reside in Russia on a permanent basis.
Additional papers when applying for marriage
Based on the foregoing, additional papers, such as:
- Marriage certificate;
- spouse's identity card.
For persons legally married to a citizen / citizen of the Russian Federation, the period, as well as the procedure for obtaining RVP, is in accordance with the general procedure.
RVP for persons under the age of majority
In the event that persons wishing to apply for a temporary residence permit are minors or are legally incompetent, documents must be submitted by their legal representatives or guardians.
For such persons, the package of necessary securities includes:
- an application for RWP, which must be signed by the legal representative or guardian;
- birth certificate;
- paper confirming the incapacity of the person (medical report);
- in the event that the paper is submitted by the legal representative, it is necessary to show the authorized person a document proving his authority to represent the interests of his ward;
- in the event that the child's age is from ten to eighteen years, you must attach his documented consent to live in Russia in writing; the document must be certified by a notary;
- a certificate confirming the absence of problems with the law and law enforcement bodies of a person who has reached the age of fourteen;
- certificate of the absence of sexually transmitted and infectious diseases;
- certificate of lack of addiction to narcotic drugs;
- a paper granting the right to a foreigner to reside outside the home state;
- two photos in size three by four.
Grounds for making a negative decision
FMS bodies have every right to make a decision that does not meet the expectations of a foreign national. The following errors in the submitted papers may be grounds for refusing to receive a RVP by a foreigner:
- incorrect filling out the application form;
- incomplete package of documents;
- non-compliance of papers with legal requirements regarding execution;
- violation of the rules of residence on the territory of the Russian Federation;
- detection of errors in the presented personal data;
- an attempt to deliberately deceive authorized bodies (providing knowingly incorrect information);
- cancellation of the quota for the region in which the papers are submitted;
- submission of fake documents.
Employment of foreign citizens with RVP
If there is a RVP on hand, it will be easier for a foreigner to get a legal job. In the event that the boss is satisfied with a candidate for a job, a foreigner will have to sign an employment contract. Further, the authorities must notify the FMS authorities about the employment of a foreign citizen by sending a letter. Admission of a foreign citizen from RVP to work is a troublesome procedure, but employers assist in the preparation of documents.
For employment of a foreign citizen with RVP, the following documents will be required:
- national identity card (if the person applying for a job does not have citizenship);
- the migrant’s card, which sets out the purpose of the visit to the country (this should be employment);
- residence permit in the state;
- medical policy;
- receipt confirming payment of state duty;
- certificate of sufficient knowledge of the state language;
- a card from a medical institution stating that the foreign national does not have dangerous diseases.
All papers must contain reliable information about their owner. In addition, papers not included in the above list may be required from a person of foreign origin, for example:
- certificate of previous education;
- previous work book;
- diploma from a higher educational institution.
Registration of foreign citizens with RVP
When applying for a RVP, a foreigner must register at the place of residence. According to the legislation, a seven-day period is given for this procedure. To register at the place of residence, a foreign citizen should contact the FMS. A foreigner must fill out a form, which can be obtained from a specialist in the bodies of the FMS. When filling out this form, corrections and typos are strictly prohibited.
The application for registration contains information:
- name of the body authorized to register at the place of residence;
- application for registration of a foreigner with personal data;
- the initials of the person who owns the housing where the foreign national lives;
- information on a temporary residence permit;
- details of the identity card of a foreign resident;
- date and signature.
When registering for residence, it is necessary that the homeowner is present, who is required to present his ID. If registration is made upon presentation of a contract certified by a notary public, this procedure can be carried out without the presence of the homeowner.
The specialist of the Navy or MFC accepts the application only upon presentation of the full package of documentation.
List of required papers for registration
The following must be attached to the application for registration at the place of residence of a foreigner:
- ID card with a RVP mark;
- a leaflet with the address of stay;
- documentation confirming the availability of housing on the territory of the Russian Federation or a contract of employment certified by a notary;
- extract from the house book;
- identity card and certificate of the owner of the premises (papers must be submitted upon registration in someone else's housing);
- application for permission of the owner to reside a foreigner.
Upon presentation of the relevant documentation, problems with registration should not arise.
