Types of activity that are not licensed by Rostekhnadzor
According to the Federal Law No. 128 “On Licensing ...” Rostekhnadzor is exempted from the need to license the following list of activities:
- operation of gas, heat and electric networks, as well as oil and gas production and pipeline trunk transport;
- storage of gas, oil, products of their processing;
- issuing certificates of digital signature keys;
- the manufacture of disinfection, disinfection, disinsection products, as well as the distribution of drugs;
- repair and maintenance of aircraft, as well as transportation of goods and passengers;
- production of tobacco and other tobacco products;
- sale of rights to exercise club rest;
- veterinary activities.
List of works no longer licensed by Rostekhnadzor
From 01.01.2006, licenses of Rostekhnadzor for activities are no longer issued in the following areas:
- breeding of breeding animals and breeding of elite species of seeds;
- maintenance of rolling stock and ships;
- transportation and acceptance of catches of marine species of resources;
- audit and appraisal activities.
On January 1, 2007, Rostekhnadzor stopped licensing travel agencies and tour operator activities, as well as design and construction of buildings, but still licenses construction of seasonal buildings.
Since January 1, 2010, Rostekhnadzor no longer issues a license for overhaul, architectural design and reconstruction.
Basic regulatory framework

The ways in which you can get licenses Rostekhnadzor
In accordance with the “Regulation on Licensing”, separate for each type of license, Rostechnadzor issues documents for organizations to carry out activities that are dangerous to human life and the environment. In this case, the inspector of Rostekhnadzor performs a pre-licensing check of the licensee (the legal entity that has expressed a desire to obtain a license) at its actual location or at the place of business.
Based on the results obtained during the verification, the special department of Rostekhnadzor makes a decision on the non-issuance or issuance of a license. If there are violations in the organization being audited, a license is not issued, and a repeated submission of a package of documents for consideration is possible only after eliminating all identified violations.
License issuance places of Rostekhnadzor
The issuance of a license for the use of hazardous industrial facilities and the operation of hazardous production is usually carried out by the Department of Rostekhnadzor at the place of the company's legal address. The Rostekhnadzor license for individuals registered as entrepreneurs and legal entities can in some cases be obtained from the Central Office of Rostekhnadzor, which is located in Moscow. Let us consider in more detail the list of cases that allow this to be done:
- the presence of foreign capital and investors in the company;
- the presence on the territory of the Russian Federation of several branches of the organization;
- licensing of a company with a turnover of industrial explosives and an expert examination of industrial safety;
- use by organizations of public benefit organizations subject to declaration.
The validity period of Rostechnadzor licenses
The licenses of Rostekhnadzor for individuals as individuals and organizations obtained after the publication of the Federal Law No. 99 of September 1, 2013, are valid indefinitely. But it may be necessary to renew the license or re-obtain a previously suspended, or even canceled permission to carry out work that is dangerous to human life and the environment. Licenses are subject to suspension or cancellation in case of non-compliance with the security requirements found during the next or unscheduled inspection by a specialized body.
Licenses that expired before 08/31/2013, or obtained licenses of Rostekhnadzor before this period in accordance with Part 3 of Art. 22 Federal Law No. 99 are deemed to be inoperative and require re-issuance.
License renewal procedure
In the process of economic activity at the enterprise there are changes that lead to the need to reflect them in the license. An application for renewal of the Rostekhnadzor license is prepared along with a package of documents for renewal, and as a result, the organization has a new license with updated data. Moreover, the package of documents practically does not differ from the one submitted for primary licensing, since the changes affect almost all documents submitted earlier. It should be remembered that the Rostekhnadzor license for individuals is granted if their activity is framed as an IP. According to the regulations, the procedure for renewal of a license takes from 30 to 45 business days. The state levies a fee of 3,500 rubles for each action when renewing a license, while for issuing a duplicate (for example, if the original is lost) you will have to pay only 750 rubles.
Also, Rostekhnadzor reissues licenses in the following cases:
• upon reorganization (transformation) of the legal entity’s ownership form;
• when changing the initials of an individual registered as an individual entrepreneur, his place of residence and passport data;
• when changing the address of the location and name of the legal entity;
• when changing the list of licensed types of services, work performed;
• when the individual entrepreneur or legal entity changes the venue of the type of activity indicated in the license.
Possible fines for the lack of a license from Rostekhnadzor
Penalties that may be imposed on the organization in the absence of a license to carry out activities are prescribed in the Administrative Code of the Russian Federation. They apply to citizens, officials and the organization itself. They are expressed in monetary terms and the number of months during which an official can be suspended from activity, and the activities of a legal entity are suspended.
