Today we will be interested in article 205. It refers to the Criminal Code of the Russian Federation. To be honest, this question generally worries many. After all, this section is called "Terrorism." As you know, this is an urgent problem of the modern world. And it is necessary to fight it. In Russia, there are a number of measures to prevent a crime of this nature. All penalties are quite strict. What relies on violators, according to what 205 article of the Criminal Code of the Russian Federation narrates?
Terrorism is ...
Before you understand the topic, you need to clearly understand what kind of crime in question. What is terrorism? After all, not all violations of the law can be called this term, but only something specific.
Terrorism is a systematic intimidation of citizens in order to obtain benefits from the authorities, a kind of behavior policy. It is usually expressed in the infliction of grievous harm to property, to people. This can be the organization of an explosion or arson, any other actions frightening the population that pose a danger to life and health.
Acts of terrorism are what terrorists conduct in order to gain profit. That is, this is a single immediate action, operation. Here it must be taken into account that in some cases threats turn out to be much more effective than actual damage.
Part 1
What we will deal with, sorted out. Now what? Further, it is necessary to find out in what cases, and what penalties will be imposed to violators. 205 article of the Criminal Code of the Russian Federation is divided into several parts. Each of them prescribes certain penalties, depending on the situation.
An ordinary terrorist act, carried out, as a rule, by one person (or the threat of its implementation) is seriously punished. Not like in other cases, but nonetheless, the punishment scares ordinary citizens.
Why? It is about imprisonment. It is this measure that many citizens associate with criminal liability. 205 article part 1 of the Criminal Code provides for imprisonment for a terrorist. On what period? It all depends on the situation, but it is known for sure that it will be at least 8 and no more than 15 years. Quite a serious punishment for conducting illegal and dangerous policies for their own benefit.
Collusion and groups
205 article of the Criminal Code of the Russian Federation (part 2) indicates more common cases of terrorist acts. It's no secret that these acts are usually not carried out alone. Instead, actions are thought out and organized by prior conspiracy of several people or by a specific organization, association. This crime is considered more severe and serious. So, the punishment will be appropriate.
As in the past, the perpetrators face imprisonment. The death penalty was abolished in Russia, so the prison is the worst thing that can only wait for citizens for violating the law. In this situation, the stay in prison will last from 10 to 20 years. In addition, restrictions on freedom after release will also be imposed on criminals. Article 205 states that the duration of the so-called suspended sentence may be 1-2 years and no more.
Carelessness and damage
What's next? Often terrorist acts are just threats. Especially if they are carried out by one person. When the act committed through negligence caused the death of a citizen or serious harm was caused, serious consequences ensued, or property was badly damaged, and a rather serious punishment was also imposed.
Which one specifically? Exactly the same as for conspiracy or work in an organized group.According to the data provided by Article 205 of the Criminal Code, it can be concluded: the guilty person will be punished with imprisonment with further restriction. At the same time, serving a sentence in prison will last from 10 to 20 years maximum, and the suspended sentence will be imposed for a minimum of 1 and a maximum of 2 years. All this applies to part 2 of this article.
Part 3
Punishment and situations do not end there. 205 article "Terrorism" provides for specific measures to prevent crime for the encroachment and use of atomic energy, radiation, toxins, toxic and biological substances, toxic or chemical materials. This also includes the deliberate murder of a citizen. The penalties for this are prescribed in part 3 of this article.
What should you prepare for if you suddenly caught the perpetrators? It doesn’t matter if it was one or several people. Everyone will be given a severe punishment. And it is expressed, again, in the form of imprisonment. It will be from 15 to 20 years, and an additional restriction of freedom will be imposed. Not too big - just a couple of years maximum. At least 12 months. The limit, as you might guess, is expressed in 24 months.
That's not all. If a conditional term not appointed, it will be replaced by a more serious punishment for terrorist acts. This is a life sentence. It turns out that for the crime committed Art. Criminal Code is able to impose on a citizen life imprisonment. Perhaps this is the most common option. Especially in cases where a terrorist act was really organized and carried out.
Exemption
But punishment can be avoided in some cases. You will have to act at your own peril and risk. The thing is that Article 205 of this Code of the Russian Federation exempts from criminal liability all who change their minds and timely turn themselves in, and also help in preventing crime.
The option of active cooperation is possible. Even if it is not possible to completely prevent the disaster, a potential criminal can be relieved of the responsibility laid down for terrorism. The main thing is that he does not participate in it after that. If the relevant authorities decide to impose a punishment for helping organize a terrorist act, then confession will serve as a mitigating circumstance. Most likely, such a citizen will be assigned a short stay in prison with a subsequent conditional term.
findings
What can be summed up? The fact is that in any case, imprisonment will follow for the commission of terrorist acts. Only depending on the situation, the length of stay varies.
Practice shows that terrorists are placed in maximum security colonies. And in fact, violators face life imprisonment, and not for some period of time. Temporary deprivation can only be hoped for by citizens who have come to their senses, who have come to the relevant authorities with recognition and helped in the prevention of crime (or actively collaborated). There are no exceptions to the rules.
Although, one is available. If the offender is declared insane, inadequate (in other words, a psycho), he will be placed in a psychiatric clinic for life. This rarely happens, but a similar situation does occur.
