When leaving, a bypass sheet is filled in to attach data to the personal file that the employee handed over all corporate values, papers, items and does not have financial debts to the company before leaving.

What does the document reflect in the company?

First, an order is issued to dismiss an employee by management, after which a bypass sheet is issued. A person must go around each unit and put the signatures of all the heads of branches. Even if the employee does not owe anything, the signature must always be.

Upon termination of employment, notes are inscribed in the bypass sheet, indicating the employee has returned some of the valuables belonging to the company:

  1. Office supplies that were issued for use are returned. These can be special markers for working with acrylic in the architectural department, special materials when developing departments of the room.
  2. The communications department must accept mobile phones, right up to the printout of calls, to confirm that all calls are made within the company’s needs. If it turns out that there was a personal relationship with relatives, the person is obliged to reimburse the cost of calls according to the basic tariff.
  3. Personal work items related to the dress code. Sometimes companies sew custom-made uniforms for workers, give out ties, aprons or hats with emblems. All things must be given up no matter what their condition. You can’t buy them, because these are accountable property of the company.

If they were purchased personally by the employee, a mark is placed on this. Of course, in the structures of the Ministry of Internal Affairs, employees who receive a form from the organization must pay for its wearing, that is, depreciation or rental use. Part of the money is deducted from the salary. Some non-departmental organizations create similar conditions and circumstances for dismissal.

The necessity and validity of the document

Each employee is interested in whether it is necessary to draw up internal documents if nothing is said about this anywhere? According to the Labor Code of the Russian Federation, there are no laws and regulations regarding how and why to fill out a bypass sheet upon dismissal. It turns out that there is no legitimacy. There is not a single article that regulates such nuances. This may be done at the discretion of the employer or accountant. Most often, such safety measures are necessary in areas where employees / employees:

  • deal with cash flow accounting;
  • work with securities and forms;
  • carry out activities that are related to the circulation of services, but it requires mobile communications, installation of programs and access to them.

Before employment, the employee signs a document on non-disclosure of trade secrets. For example, when dismissing a bypass sheet serves as a guarantee of securing production secrets at an industrial enterprise. Is a document needed when working with finances?

In the first case, it is about working with money. This includes both bank employees and simple bookkeepers who stand at the cash registers in supermarkets and gas stations:

  2. At banks, the operator-cashier or cashier who deals with currency exchange must hand in the personal codes issued to him during employment.

  2. It is very undesirable to lose the form, because the document needs to be fixed in the system.
  3. Otherwise, the whole organization will suffer losses.

Therefore, forms and papers are assigned to the employee, and upon dismissal, the amount of the balance is indicated in the bypass sheet. The form blank is regarded as evidence of unused securities.

Risks and bypass protection

  1. If the manager has forgotten to perform actions related to the protection of personal data, then it is no longer possible to force him to sign a bypass sheet upon dismissal of the employee.
  2. All consequences are a risk to the authorities. It is recommended to clarify such points in advance. An employee can quit during the vacation period, and even on the day of the application for urgent reasons according to the Labor Code of the Russian Federation.

Important! Employees of the Ministry of Internal Affairs are subordinate not only to the labor code, but also to the order of the FSVTS No. 63-od p. 16. The commissioner of the department of internal affairs should establish the obligation in the signature of the document.

In the third case, when it comes to mobile communications, the employee must return all the phone numbers and card numbers issued to him for the performance of official duties. We can also talk about material and commodity values, when employees are given online cash equipment, transport, coupons for refueling, free use of public transport, passes to the building and other company valuables. Separately, goods cards are filled in if the person worked at the warehouse. According to the Labor Code of the Russian Federation, an employee is exempted from filling out all the documents of internal regulation if he is on parental leave during which he decided to quit. This is legitimate because a woman transfers all matters, powers and obligations to another employee. It is impossible to demand formalities from her, even if she legally retains any values. In such cases, an inventory is made, however, the authorized employee must fill out all the strict reporting forms addressed to the employee who went on maternity leave and dismissed. Can they not give out a work book in the absence of a bypass sheet?

It is worth talking about the legality and legal force of internal documents when an employee is an employee and uses state-owned property. This also includes the status of items issued under the report, which must be repaired or corrected after the use of workers. However, this point has nothing to do with paperwork. According to Art.84.1 of the Labor Code of the Russian Federation, the employer is obliged to issue the workbook to the employee on the day of dismissal, but nothing is said about filling out third-party documents that would display information about the delivery of values ​​or other things of the company.

There are other legitimate cases:

  1. According to Articles 137-138 of the Labor Code of the Russian Federation, if an employee has debts to the employer, all forfeits must be paid by deducting debts from the salary.
  2. If the obligatory nature of such an action has occurred after the signing of the order of dismissal, an examination should be carried out on the causes of damage to the values.
  3. Even if the employee did not sign the documents, the work book should still be issued within the time period established by law.
  4. If there was an order to reduce staff, and the person worked part-time, no agreement is required to additionally fill out a bypass sheet.

Moreover, the employee must be notified of the reduction so that he can find a new job. Recalculation is also carried out, the employee is charged three days before dismissal. This is legally legal, because a person must live on something until the moment when the official day of settlement comes. If it is impossible to contact him, the responsible person must by registered mail notify the person of the management order. Until the fact of dismissal, all necessary and important documents are stored in the archives of the enterprise for 70 years.

When a person gets a job, they can appoint a trial period of 1-3 months. The period is not regulated by law in any way and may vary in duration depending on the complexity of the position held in the future. Also, at the end of the term, an employee may be tested. If he does not cope with his duties, the management may remove him from passing the probationary period or dismiss him if he passed the test, the probationary period has ended and he was immediately approved for the position.

At the same time, a person is also obliged to hand over all the things that belong to him that belong to the company:

  3. Also, when a period of up to 2 months is reached, in any case, a form is filled out, where an inventory of the property used by the person is made, a document on non-disclosure of trade secrets is signed, a form for issuing and returning values ​​is completed.
Whom the bypass sheet protects

Provided that the employee does not work according to the labor code, but is given personal work things, valuables, etc., his superiors should understand that this is a risk - if a person does not return some things, you need to deal with the situation in court, however, explain the reason non-statutory employment will also be necessary. Perhaps, in some cases, you need to pay a fine for unauthorized use of labor, tax evasion, and so on.

It is in the interests of the employee to immediately sign an employment contract in order to have at least some arguments in court if the proceedings reach justice. An employer should also be attentive to formalities, as sometimes employees hide their age, getting a job until adulthood. And in this case, a trial period is not assigned, an employment contract is mandatory, the term of which cannot exceed three months.
