Unfortunately, beatings against relatives in our country are common. Beating is no longer a crime?
The beatings against loved ones are decriminalized by a new bill adopted by the State Duma, that is, transferred to the category of offenses from criminal to administrative. So, on February 7, 2017, the President of the Russian Federation approved the law and the amendments made to Article 116 of the Criminal Code of the Russian Federation. Earlier in the Criminal Code, article 116 was used to qualify beatings against close persons, which provided not only corrective and compulsory labor, but also a restriction of freedom with a maximum term of two years. This applied both to those who beat relatives and close people, and to those who showed violent acts motivated by racism, robbery and hooliganism.
Under the new law, beatings for the first time by a rapist against loved ones are no longer considered a criminal offense. Relatives are the wife, children, relatives, as well as workers helping with housework and housework. And today the punishment does not provide for restriction of freedom if the injured were inflicted physical pain (abrasions, bruises), which did not cause any harm to health. Moreover, according to article 116, the punishment for violence for the purpose of disorderly conduct, robbery, interracial activity remains the same.
What punishment is provided for beatings in relation to loved ones?
The main argument in favor of decriminalization of violent acts that caused physical pain to loved ones and did not harm their health is the reduction in the number of interventions in the personal life of the family by the state. In addition, after the adoption of the law in 2016 on criminal liability for beatings against loved ones, cases of deprivation of parental rights and placement of children in orphanages for bruises and abrasions increased. To prevent this, amendments were made to the bill and article 116 of the Criminal Code.
In accordance with article 6.6.1 of the Code of Administrative Offenses, a fine of 5,000 to 30 thousand rubles can be imposed for domestic violence today, compulsory work up to 120 hours or arrest up to 15 days can be assigned.
If the beatings against relatives are repeated, the victim will be able to use article 116.1 of the Criminal Code, where the rapist can be held liable in the form of a maximum term of restriction of liberty of up to three months, a fine of up to 40,000 rubles, corrective or compulsory labor.
How a home tyrant behaves
Submission of a woman to herself is the main form of manifestation of a tyrant. This becomes especially noticeable when a woman is on maternity leave and becomes financially dependent on her husband. Then the home tyrant restricts his wife financially, forcing him to beg money from him even for some necessary little things.
At the same time, most often, pressure begins, designed to reduce the woman’s self-esteem - constant statements that no one needs her, that she is a bad mother, mistress, etc. The husband loses the skill to ask - he demands, cannot calmly express a claim.
Screaming, throwing objects, slamming doors - becomes his normal behavior.Moreover, in his breakdowns, he blames exclusively the woman, claiming that it was her actions or words that caused him such a negative reaction. How to determine that a man has a tendency to violence
A family tyrant can not always be recognized immediately, the candy-bouquet period of relations with such a man is full of positive emotions. Psychologists attribute this to the fact that tyrants with strangers are often distinguished by excellent self-control. How can a rapist manifest himself:
- The criticism is in a derogatory tone - he does not like the book that a woman reads, does not like the dress, which “makes her full” or “looks indecent”, does not like her hobby. He admits ridicule, "jokes" about the appearance, mind, skills of a woman.
- The ousting of friends and relatives from the social circle begins, as well as negative statements addressed to them.
- Bans, for example, to wear short clothes, a neckline, to communicate with friends without his presence, to communicate on social networks with people of the opposite sex. There are two ways out of a situation in which a woman is faced with violence by her husband (enduring beatings until her death is not a way out):
- Persuade your husband to consult a specialist psychotherapist who will teach you how to manage your anger. True, in the case of such a proposal to her husband, the woman runs the risk of being seriously beaten again, since the family tyrant does not see any guilt and does not believe that the problem is in him when he shows cruelty and applies beatings to relatives.
- Flight and divorce. In that order! The threat of divorce and "leaving to mom" does not work. Before a divorce, you can stay with relatives or friends. If a woman has already allowed herself to be left in a social vacuum and she has “nowhere to go,” then she should seek help in a crisis center for victims of domestic violence. But in any case, parting with the family tyrant can save the health and even the life of a woman, as well as the psychological health of her children.
