A patent is a special document that gives a migrant an official right to legal employment.

The right to carry out work without a patent are citizens who:
- have the status of a highly qualified specialist and members of their families (if they work by special permission);
- they are students in the Russian Federation on full-time studies in a professional educational program, which must be state accredited;
- have a work permit issued on 01/01/2015. This document is valid until the end of the term;
- They are citizens of the states that make up the EurAsEC (Belarus, Armenia, Kyrgyzstan, Kazakhstan).
What documents are needed to file a patent?
In order for a foreign citizen to receive a patent, it is necessary first of all to apply to the relevant department of the Ministry of Internal Affairs on labor migration issues. And no later than 30 days from the moment of entry into the country. It is necessary to provide the following list of documents:
- statement;
- color photo (30x40 mm);
- passport;
- a document officially confirming the absence of diseases that could harm others (drug addiction, etc.);
- a contract for the provision of paid medical services or a policy for voluntary medical care;
- a document that confirms that a foreign citizen speaks the official language of the Russian Federation - Russian, knows the history of the country and the basic legislation.
In case of untimely application for a patent, a foreign citizen is obliged to pay a fine for the violation. The size of the fine varies from 10,000 to 15,000 rubles. After the payment of the fine has been made, the foreigner has the right to contact the appropriate service to obtain a patent. Mandatory to the list of required documents must be attached receipt of payment of a fine.

How can I find out if a patent is valid?
Unfortunately, it is not uncommon for a foreigner to grant an invalid patent to an employer. That is why the employer must know about the methods of checking for validity and how to find out the status of a patent:
- Thoroughly examine the document presented by the foreigner and correlate with the legal requirements.You can also consider the degree of protection under an ultraviolet lamp.
- Use the online service of the website of the Ministry of Internal Affairs of Russia. In special columns you must enter the code from the picture. However, note that the database cannot be updated every minute.
- The most reliable way is to send a request for the status of a patent to the body that performs migration registration.
How do you know the patent validity period?
A foreign citizen can find out the validity of a patent in only one simple way - on receipts of payment of income tax. A patent is issued for the number of months for which a tax payment has been made. So, the tax amount in different regions of the Russian Federation is different. For example, the smallest amount of tax in the Altai Territory is 1568.40 rubles. for 1 month. Accordingly, in the capital, the tax is higher - 4000 rubles. Migrants often pay quarterly.
How to renew a patent?
Every foreign citizen has the full right to renew his patent. It is only necessary to make the appropriate amount of payment for the following months, the status of the patent in this case no longer needs to be checked. Often, migrants have several receipts in their hands.
However, the patent can be extended for no more than a year. If the deadline has expired, the foreign citizen must leave the country or apply for a patent again. By the way, the so-called mass replacement (renewal of patents) began only in January 2016. Indeed, for Russia this procedure is new.
When can a migrant be fined?
Obtaining a patent – a long and serious process, which is regulated by many legislative acts. Accordingly, for each of the violations an administrative penalty is automatically imposed. However, this rule applies both to a foreign citizen and to his employer.
In Art. 18.10 Administrative Code refers to the labor activity of a foreigner without a patent. For any offense, a fine is imposed. Its size is from 2000 rubles to 5000. If the situation is repeated again, then the size of the fine rises to 7000 rubles. The last resort is the expulsion of the perpetrator from the country.
If the employer knowingly hired an employee who does not have a special permit, then he will be fined:
- 2-5 thousand rubles. for an individual;
- 25-50 thousand rubles. for an official;
- 250-800 thousand rubles with suspension of activities for the organization.
