Writing a leave statement for several hours, a sample of which is provided in the personnel department of the company, is the right of the employee who wants to take leave at his own expense due to circumstances or at the expense of overtime unpaid time. Depending on the reasons, the person is exempted from work with or without compensation.

In what cases can I request a day off?

An application for a few hours off or on account of the hours worked is drawn up by company employees to resolve urgent urgent matters. When it comes to a document of this type, circumstances are taken into account. You can get the law by time off:

  • on account of vacation;
  • at own expense;
  • for processing that has not been paid.

Legislation and Labor Code

Since there is no punishment for absenteeism in the Labor Code of the Russian Federation if it lasts less than 4 hours, administrative liability only arises in cases where a person urgently needs to leave his workplace for a whole working day. There is no such thing as a few days off.

A few hours off

There is only a short-term form of vacation at the expense of working time, but it will need to be worked out or it has already been worked out in advance.

If we talk about the use of leave, the application is written for days at will at the expense of general leave. This is a permissible measure, especially for employees of the Ministry of Internal Affairs, who are not allowed to divide the entire rest into several periods. This trick helps only when you need one week out of four or five full.

If you need to take only one to three hours, then it is better to write a statement for a few hours off on account of processing or with the transfer of mining. It’s just that at your own expense without working out it’s hard to take a free day to relax, because everyone who just doesn’t want to get up early or on night shifts can do it this way.

In the Labor Code of the Russian Federation there is the concept of time off, which is described in article 153. Based on Article 128 of the Labor Code of the Russian Federation, a person can be given as many hours or days as he needs to solve cases of a personal nature, such as:

  • the funeral;
  • wedding;
  • birth of a child;
  • urgent help to a relative;
  • family circumstances.

Also, the period of absence of an employee at the workplace is determined by agreement with the bosses. Also in the Labor Code and usually in the contract it is indicated that the employee of the company has the right to leave for family reasons, and during this period he cannot be called to work, as well as dismissed. The reason can be justified by contacting the staff or the authorities. In this case, a service note is drawn up for a few hours off.

If you do not know how to write a day off for a few hours, compose it in any form. It has no template forms and is most often written in free form. It is possible to draw up an application on the model of a few hours off time, which is provided by a staff employee upon the oral request of an employee.

  2. The reason is described.
  3. The date, starting from the moment of absence, and the period of the required period for solving personal problems are indicated.

Provided that you can take time off in advance, for example, for repairing the heating system, it should include strong and convincing arguments. However, this will not be included in the vacation account, since it is not a reason or a necessary measure, and unplanned leave is most often not included in the total number of paid days. Of course, relations with the management should be taken into account - many of the principle do not meet, not wanting to enter the position of an employee.

The validity of the weekend

The following is an example of how to write a leave statement for a few hours:

"I ask you to provide me with an additional day of rest on June 13, 2013 for working on a holiday on May 1, 2013, which was not paid at a double rate, and therefore I think that I should be taken time off."

When you don’t want to lose money, and you need to take the weekend, you can use the convenient wording: “I ask you to provide two calendar days for paid leave from 10/05/2018 to 10/06/2018."

At the same time, the employer will not be able to refuse you, even if the following days are days off. However, here you should follow the formality:

  1. The balance of all unused vacation should be at least 14 days excluding holidays, minus the two days requested.
  2. It is necessary to draw up a statement in three to four days so that personnel officers can issue an order.

If you don’t know how to write a leave statement for several hours, ask the employee of the company responsible for the calculation of working hours or time sheets to write a sample.

Additionally, many workers take a few days off for work days on weekdays. This is strictly indicated in Art. 113 of the Labor Code of the Russian Federation. If they were not paid, but recorded, for example, in the register for the time of arrival and departure of employees from the workplace, the employee should be reimbursed for processing in the form of an additional payment or a day off.

In this case, you need to refer to an individual contract. It may contain special employment, which assumes not a 40-hour week, but also an appropriate salary. According to article 153 of the Labor Code of the Russian Federation, an employee has the right to receive double payment for work on a day off, or a day off with payment at a single tariff rate. It turns out that there will be a payment in any case, but they do not always give time off, reimbursing employment with a double tariff.

Holidays for working off on holidays

Important! If the company has an official day off on the occasion of March 8 or February 23, as is usually the case, but employees are told to work Saturday afternoon, work is paid at a single rate. Holidays on holidays granted by order of the state, and all payments are saved. But under article 152 of the Labor Code of the Russian Federation, a person can choose whether to receive monetary compensation for processing (not to be confused with the previously worked time) or whether to go on a holiday not according to plan. Family circumstances

Some employees believe that they are required to provide leave at the expense of the employer if they have special family circumstances. The Labor Code says something completely different:

  1. Day off is granted at birth, marriage, death of close relatives.
  2. You can only issue a vacation for 5 days by law.
  3. Leave for family reasons is not paid if it is not included in the bill paid.

There is a small nuance: if an employee tries to deceive the employer, for example, take a three-day leave for marriage, but include it on leave and receive money, then later, when checking documents, an overlay will be revealed. On the other hand, unlawful leave due to family circumstances is prescribed only by law, and, as a rule, an employee is required to issue it so that later there are no problems with documents.

If a person indicates otherwise in the application by family circumstances that is not provided for by law, they may be given time off for up to five days. For example, forced husband escort to the hospital, patient care, etc. Moreover, a person must work at least six months in this work if he:

  1. Not in position.
  2. Does not care for a child until he reaches the age of three.

Women can be given hours of leave or paid days off on vacation, even if they do not have six months of work experience. On the occasion of the death of a relative, the day off issued for five days can be extended up to 14 days without payment, if circumstances of death so require, a criminal case has been opened or an investigation is underway.

Everyone has the right to time off if he belongs to the category of persons specified in the Labor Code of the Russian Federation. At the same time, the workplace and seniority are maintained. Separately, there are several categories of citizens who can, without a statement, provide significant evidence for obtaining time off:

  1. Those who are a donor and donate blood for those in need - are given a day off on the day of blood donation.
  2. Donor certificate on an ongoing basis - is given no more than three days a year without saving payment.
  3. Persons who pass entrance and final exams - up to 14 days of vacation.
  4. Persons who work under a collective agreement.
  5. Minors, but over 16 years old, who are employed for a term of work from three to six months.
Day off for family reasons

Certain categories of citizens have the right to receive time off from a few hours to five days at a minimum if they:

  • participants of the Second World War, whose total vacation is 35 calendar days;
  • working pensioners - get up to two weeks off;
  • victims of a terrorist attack or relatives of deceased parents who still have minor children;
  • working disabled people - leave up to 60 days;
  • injured military personnel - up to two weeks a year off;
  • adult workers receiving a second and subsequent education - up to 15 days off.

All these rights are strictly regulated in the Labor Code or in the contract drawn up when hiring. If the employer refuses the legal grounds for issuing several hours or days of vacation, he faces a fine and moral compensation to the person.
