What threatens an expired passport

The main document for any adult citizen is his passport. According to the legislation, it needs to be updated at least twice - at 20 and at 45. However, there are situations when it is not possible to comply with the terms of exchange set forth in the FMS Rules. What may expire an expired passport and how to avoid penalties, we will understand.

The administrative regulation of the FMS, in which the procedure and passport replacement dates, indicates the following reasons when the passport can be replaced:

  • achievement by a citizen of twenty or forty-five years of age;
  • change of surname, name or patronymic;
  • change of personal data - place, date of birth;
  • sex change or cardinal change appearance;
  • wear of the passport or its significant damage;
  • correction of errors made in it.

Moreover, all these grounds do not have a clear time frame with the exception of the first two. In relation to them, the Rules indicate clear deadlines - the document must be replaced within 30 days from the day of the event. After this period, you have an expired passport in your hands. The Code of Administrative Offenses provides for the imposition of a fine for living with an invalid passport (Article 19, paragraph 15).

According to the same Code, the size of the fine for living on the territory of our state without an identity card varies from two to three thousand rubles. Residents of cities of federal significance (recall that Moscow and St. Petersburg are among them) were less fortunate in this regard. The fine for an expired passport for them will be three to five thousand. The amount of the fine in each case is left to the discretion of the FMS inspector. He can recover for an expired passport as 2, so 2.5 or 3 thousand rubles. If the passport was damaged due to careless handling, a fine of 300 rubles will be imposed.

This situation already concerns residents of Ukraine living in the territory of the Russian Federation. The fact is that the passport of a citizen of Ukraine has no time limit, but when they reach 25 and 45 years old, it is necessary to paste a new photo into the passport. As in Russian law, this procedure takes 30 days. In case of delay, a fine is imposed, which can reach 51 UAH. You can paste the photo only in the passport office serving the region where the person is registered. To replace, you must provide two photos and the document itself. At the same time, any person from the citizen's entourage whom he trusts the documents can submit for registration, but he can only pick up his passport with a pasted photo.

Thus, the situation when the photo is expired in the passport can become quite serious. After all, according to an expired document, it is impossible to pass customs control, and consulates work only with foreign passports.

Who can avoid a fine

Nevertheless, the legislation refers to categories of citizens who can count on leniency for an expired passport. These include:

  • Persons under the age of 18;
  • pregnant women or mothers with young children;
  • patients who have been officially recognized as insane and undergoing treatment at a medical institution at the time of the change of passport;
  • persons held in places of detention;
  • soldiers performing military service.

In addition, the category of extenuating circumstances includes voluntary appearance at the FMS department or difficult life circumstances.

Among the aggravating circumstances, only one thing is mentioned - the continuation of the offense, despite the requirements of the authorized bodies to terminate it.In this context, a long delay can be considered.

If you have written a fine

If you nevertheless received a fine order because your passport is expired (what to do, these are the rules), you should not get upset ahead of time. If you have valid circumstances, and you can prove them, there are 10 days to appeal. If, for example, you were on a long business trip or were in the hospital, and this can be documented (sick leave, travel documents, tickets), then, most likely, after considering the case, the penalties will be canceled or reduced.

Replacing an expired passport

If the fine for the expired passport is nevertheless confirmed, then it will have to be paid. This is given 60 days. In case of non-payment, the citizen risks being subjected to the following sanctions:

  • the same amount will be added to the amount of the fine, but in double size;
  • in addition to paying the fine, compulsory work for up to 50 hours can be assigned;
  • deadbeat may be exposed administrative arrest up to 15 days.

Accepted sanctions will be implemented by bailiffs for two years. Accordingly, during this period personal accounts, property and the possibility of traveling abroad may be blocked.

Replacing an expired passport

If the passport has expired, do not aggravate the situation. The sooner you arrive at the FMS, the better. Moreover, with minor delays, inspectors are often limited only to verbal remarks. Replacing a passport is the same as in normal mode. For this, a passport, 2 photos, a receipt on payment of state duty and a statement in form 1-P are handed over to the FMS inspector. In order to put the necessary marks in the passport, provide:

  • military ID;
  • document confirming registration;
  • birth certificates of children under 14 years of age;
  • certificate of marriage or its dissolution.

By law, documents must be accepted immediately. Having received a resolution on administrative violation, a citizen pays for it at a bank branch or in a payment terminal, and returns the payment document to the inspector. The rest of the procedure is no different from the usual. A new passport is issued within 10 days at the place of registration. If the documents were handed over at the place of residence, then the issuance period is increased to 60 days.
