Today we will try to figure out who can be the judge and what is needed for this. After all, this is not a simple job, but a presentation of law enforcement agencies! Judges will have to resolve important contentious issues based on the rules established in the country. Not everyone has this opportunity. What should you pay attention to first of all?
To not be ashamed
The first thing that is required of a potential candidate for judge is an understanding that the profession will not be a simple job, but the meaning of life. Not mandatory in terms of established rules, but a very important point for any person. The life of this or that person may depend on the decision of the judge. Therefore, you will have to devote yourself entirely to work.
At the same time, you should pay attention to one more point - your relatives should not have problems with the law. In Russia, this rule applies to close relatives. These include: grandparents, brothers and sisters (relatives or steps), spouses, parents, grandchildren, children. In principle, this is enough. Therefore, if you are interested in who can be a judge, keep in mind that only those whose families did not have a criminal record have such an opportunity. Exceptions can be made when applying for a position, but this is a huge rarity.
Education
Of course, an important point is such a point as education. Here it should be mandatory. If they can take on regular work without a "tower", then here - no. Justices of the peace, like any others, must be educated.
It is indicated that potential representatives of the law must have a higher legal education. No technical schools or courses. Yes, they will be able to play their role (positive), but only if there is a legal "tower". Without her, you will not be able to get a job as a judge.
How many higher educations do you need? As many as you want! The main thing is that one of them be legal. Now it’s clear who can be the judge. But this is far from all the rules. What else should you pay attention to?
Age and experience
Age also plays a role. No one is recruiting young judges. There are practically no such representatives of the law in Russia. How old should a judge be? There is no judicial representation under 25. And it is right. Indeed, according to the established rules, only a citizen who has crossed the bar at 25 years of age has the right to undergo special testing. Younger candidates will simply not be allowed to test. Typically, this rule applies to judges of the arbitral tribunal.
These are far from all limitations. It is worth paying attention to the fact that in addition to legal education, you should have a certain length of service. As candidates for judges are considered adult citizens who have worked for at least 5 years in the field of jurisprudence. That is, a person without experience (for example, a newly graduated law student) will not be accepted as a candidate for the post of a judge. Such rules are currently established in Russia. And, again, they operate for the lowest instances of the judiciary.
No problem
Who can be a judge? We have already figured out that only citizens who have no relatives in the family had problems with the law will be considered as candidates for the post. But this is not all the features that are taken into account.
What is this about? That the judge is a representative of the law in the country. Therefore, he, too, should not have problems with the law. A crystal clear judicial history is another requirement for a candidate. Even drives in children's rooms of militia will be taken into account. Usually no favors are given to candidates. Consider this fact.
It is also necessary to pay attention to the fact that only a capable and mentally healthy citizen has the right to nominate his candidacy as a judge. If there is a certificate confirming the deviations of the psyche, you can forget about this profession. Sometimes even having a potential candidate have such a document can play a trick.
Who can be a judge? A man without any addictions. That is, you should not be registered anywhere. Close relatives should also not have similar problems. This is also sometimes paid attention to. Especially if there are controversial issues when choosing candidates - they usually take as judges those who have maximum compliance with all requirements (in case of identical test results).
Federal and Appeal Courts
In principle, this is where the basic queries end. By the way, a huge role is played by where the judge will work. The job site also plays a role. Or rather, the type of court. For lower authorities, we have defined the requirements for experience and age. But there are even higher courts. For them, there are other restrictions in this regard.
For example, becoming a federal judge or working in the courts of appeal is much more difficult. After all, age limits are set at 30 years. You cannot work in similar instances with 25, as is the case with justices of the peace.
Some restrictions are also imposed on seniority in the field of jurisprudence. It is increasing, albeit slightly. To work in the federal courts of the district or the appellate judicial bodies, you will have to work hard for 7 years instead of the previously established 5. Such rules apply throughout Russia. Of course, all other requirements with regard to criminal record and education with legal capacity also apply.
Supreme Court
The selection of candidates for the judiciary is not such a simple matter. Judges are recruited according to strict criteria, after following certain rules and passing the test. In addition to the Federal authorities, there is also the Supreme Court of the country. Many aspire here, but not everyone succeeds.
Why? Firstly, age restrictions are significant. In the Supreme Court, only a citizen who is at least 35 years old can be a judge. Secondly, there is a seniority. If you already work as a judge, you don’t need to worry much. Indeed, in the field of jurisprudence, you must have at least 10 years of work experience. Moreover, it is in the legal sphere.
Constitutional Courts
Many seek to get to the Constitutional Court of the Russian Federation. Perhaps this is the highest "rank" for any judge. And here, too, there are their own limitations on work experience and age contingent.
To work in the Constitutional Courts, you must be over 40 years old and at the same time have a working practice in the legal field (any) for at least 15 years. Otherwise, you will not be allowed to test. A word of advice - arrange to work as a judge in the lowest instances. Then it will be easier to get to the "top".
Sites of magistrates (and not only) are available in each city. Therefore, you can try to get into the authority that is closer to your place of residence. This makes me happy. After all, you do not have to go to another city to continue your career. Now it’s clear what kind of requirements are put forward to the candidates and who can become a judge. Therefore, you will have to think about this career at an early age!
