A rather frequent article recently on the roads is the Pedestrian Impact section. It is not known for what exact reasons this is happening - either the drivers do not know the rules, or they began to behave "rudely," or the pedestrians themselves literally jump under the wheels of cars. This is not so important. After all, the fact remains. And for a collision with a pedestrian at a pedestrian crossing (and not only) a certain penalty is imposed. This is not always a criminal offense, usually the first time is bypassed by administrative measures. For example, fines.
What
But first, what kind of process is this? It is not always and not everyone understands fully. Therefore, this will be discussed now. Indeed, for any offense and violation of the law there is some kind of exact wording.
Hitting a pedestrian is a process in which a participating vehicle (moving) hits a person on the road. Well, or a man himself comes across for some reason a car. According to all traffic rules, before starting a trip at a pedestrian crossing, the driver must make sure that no one is going to cross the road and that no one is on his way. That's how easy and simple it is.
An exception
But this kind of event has a number of exceptions. Hitting a pedestrian is not considered as such when a citizen on the sidewalk himself jumps / rushes / runs under the wheels of a moving car.
Practice shows that proving innocence is quite difficult. In this situation, a DVR will help you, which will record all offenses. And you can avoid punishment. So, be sure to install this technique in your car. You can not do this, but no one is safe from collisions. And then prove your innocence will be extremely difficult. Keep this in mind before driving.
Types of Responsibility
What's next? What responsibility is imposed on the driver for the so-called pedestrian collision? This is worth knowing. Of course, no one will immediately answer this question. A huge role is played by circumstances and the outcome of the case. Nevertheless, there is something generalized in this matter.
For example, the nature of responsibility. Hit a pedestrian (at a pedestrian crossing and not only) is punishable by three types of punishment. Criminal liability may arise, administrative and civil.
By the way, before you drive, remember - a car in Russian law is considered an object of increased danger. And you have a huge responsibility for events with his participation. Therefore, most often the drivers are to blame. Proving your innocence is now easier, but not everyone is able to do it. More on each type of punishment below.
Civil responsibility
Perhaps the most common case is the onset of civil liability at the driver after a pedestrian was hit. Fine in this case will not be charged. Instead, people figure it out themselves.
How exactly does this process happen? The driver must fully compensate for the damage in monetary terms to the victim. For example, to pay all the losses during the treatment period (if necessary), to pay non-pecuniary damage, and so on. Usually, law enforcement agencies are not contacted in this case. Everything is decided on the spot "quietly". True, civil liability applies only to minor injuries sustained from a collision. If the character is more serious, then you can not do without other penalties. Which ones?
Not too dangerous
Of course, the Code of Administrative Offenses is a means of regulating relations on the roads. And this is where all the penalties that threaten a citizen for hitting a pedestrian at a pedestrian crossing are prescribed. Article 12.24 clearly indicates the types of liability that will be imposed on the driver. If the civilian “option” does not work, then we can hope for an administrative one. What it is? Fine, of course. And its size can vary.
Light damage that is not too hazardous to health is not severely punished. Although these fines and penalties can bring you quite a bit of trouble. If minor damage was caused as a result of a collision (short-term damage, minor disability, anything that is not life-threatening for a person), the driver may be fined from 2,500 to 5,000 rubles. Such norms were back in 2015. And now they have not changed.
But the average damage is not so pleasant. Hitting a pedestrian here imposes a harsher penalty. And it is imposed in the event of an average disability, as well as for similar damage to health. In this case, the driver will pay from 10 to 20 thousand rubles in the form of a fine. In principle, this is better than being "behind bars".
Deprivation of rights
These are not all the types of administrative penalties that a driver may be waiting for. For example, a collision with a pedestrian is punishable not only by a fine. But more severe penalties. And all this is included in the mild or moderate harm caused to health.
What is this about? About such an administrative punishment as deprivation of rights. Yes, it’s not so pleasant, but sometimes it’s such a method that prevents violation of the rules of the road and “educates” drivers.
In case of minor harm, you may be deprived of a driver’s license for a period of 1 year to one and a half. In principle, it is not so dangerous. But, you see, tangibly. Especially if without a car you are not able to work normally and move around the city. And average harm is punishable for up to 2 years of life without rights. Frankly, such cases occur quite often. Although in an accident, they try to agree on a civil violation or a fine.
"Corner"
Hit a pedestrian outside the pedestrian crossing (punishment, grievous bodily harm caused by the event) or within it may be criminally punishable. Here, as in all past cases, several types of punishments are considered. It all depends on the specific situation as a whole. However, keep in mind - criminal punishment most often threatens either "malicious" violators, or grievous bodily harm citizen.
For bodily harm you can run into forced labor. In the same way as in the case of severe deaths. True, the timing here varies. In the first situation, the driver can be forced to work up to 2 years, in the second - up to 4. It seems to be not too critical, but, nevertheless, not the best outcome. Although, if you choose between all the other methods of combating traffic violations, this is the most humane approach. What else is supposed to violator? What types of punishments are there?
Restriction of freedom
For example, you can stay in custody for a certain period of time. Or just be a detainee. In any case, a collision with a pedestrian with severe forms of damage will be punished according to the law. And in this situation, if forced labor is considered insufficient punishment, you will have to put up with the so-called arrest.
Limit freedom with severe damage can for 3 years maximum. Or you can consider prison options for a given time period. In addition, there is a place to be arrested. It is imposed for up to six months. Additionally, you, of course, will be deprived of your rights in cases of such offenses. For a maximum of 3 years. It all depends, as already mentioned, on the severity of the accident and its outcome.
But when there are deaths due to collision, rarely anyone gets off with deprivation of rights and forced labor. Here, more and more seriously. Most often, a citizen will be sentenced to up to 7 years of imprisonment. Previously, this "bar" was lower and amounted to no more than 5. At the same time, confiscation of rights is mandatory. Sometimes even the vehicle that participated in the accident.
Summary
As you can see, everything is not so easy in our today's question. Practice shows that most often, regardless of where exactly the collision occurred, drivers will pay. Although, if you have a registrar in the car that can record all violations, this will be a huge plus.
Often, citizens themselves violate the rules for crossing roads, and drivers here are simply victims. In this situation, punishment can be avoided. Only have to prove their case. If you manage to do this and also demonstrate that you were not able to prevent the disaster, there will be no significant and drastic punishment for you. Unless you can "get off" with a small fine. Although, when you are completely innocent, you can just forget about the accident, as a nightmare. Be careful on the road. It never hurts.
