Registration on the cadastral registration of a property is a mandatory and necessary procedure for registration of ownership. As a result, key information about the building is entered into the USRN.
The main objectives of the process
To become a full owner and to be able to sell the property (sell, leave as an inheritance or lease), the owner needs to register with the cadastre. If the cadastral registration of the property has not been made, the owner is strictly forbidden to dispose of the land or buildings on it.
The following persons can apply for such a procedure:
- property owners;
- owners of objects that have received them by right of inheritance;
- tenants in case of operation of the building for more than five years;
- holders of long-term use rights.
In addition, cadastral registration of a real estate object can be carried out by a representative on behalf of each of the above persons, but only after the submission of a power of attorney.
Also, the legislation of the Russian Federation stipulates ways of filing documents for the registration procedure:
- personal visit to the cadastral service,
- sending by mail a completed application with a list of all necessary documentation and with a receipt of delivery.
Application methods will be described below.
Procedure outline
At the legislative level, it is determined that cadastral registration of a property should take no more than 18 days. Moreover, this period cannot be regulated even if a request for the necessary documentation in other services is required. The implementation of absolutely any real estate transactions (sale, rental, gift) implies the presence of a cadastral passport for the owner. And this means that all objects without exception are subject to accounting.
When registering any kind of real estate, you must:
- fill out and submit the application in the prescribed manner to the appropriate authorities - the nearest department of Rosreestr;
- attach to the application the entire list of necessary documentation;
- receive official confirmation of acceptance of documents - receipt;
- wait for the submission of a notification of registration or denial of registration;
- get a cadastral passport to a pre-registered object.
Each paper provided during the design process is stamped with a date. Moreover, during the personal submission of securities, the cadastral registration authorities undertake to issue the owner a receipt containing not only the date, but also a list of all the documentation submitted by the owner.
In the case when all the necessary papers, and in particular the statement of the bearer, are sent to the registration authority by mail, the employees of this organization will send a receipt on the next business day to the address indicated in the document. Moreover, a copy of the registered application is considered a receipt. Subsequently, these papers are formed in the accounting file and are marked with the individual number of the registered person.
Registration on the cadastral registration of the property: documents
To implement the process, you will need:
- a statement in the form approved by Order No. 577 of the Ministry of Economic Development of the Russian Federation of October 14, 2011;
- check confirming payment of state duty;
- boundary layout of the facility;
- technical plan of registered real estate;
- certificate of ownership of the owner.
To obtain a technical plan, the owner will need to enlist at least one of the following documents:
- admission to the operation of real estate;
- project of the facility;
- BTI technical passport received before 01/01/2013.
Registration for cadastral registration of a property upon declaration
A declaration is a document of a standard form, acting as a supplement to the technical plan. The declaration describes key information about the property: parameters, main purpose, availability and number of buildings on the site. In addition, it contains information about the owner and his rights to the land allotment.
Most of the declaration is in print format. However, time does not stand still, and nowadays, an electronic method of presenting all the necessary documentation has become increasingly used. That is, a technical plan is created on a computer, and then it is certified by a digital seal of a specialist of the cadastral organization.
In this case, the documentation is filled on a plain paper sheet without typos, inaccuracies or errors in blue ink. After which the owner signs the document and scans it in a fairly high quality (at least 350 dpi). The scanned file is transferred to the cadastral engineer.
The timing
A long process is the cadastral registration of a property. The timing of the procedure is stipulated at the legislative level. The implementation of the cadastral registration process cannot be carried out for more than 1 month from the day when the official application for registration of the property was submitted. The final day of the process is considered to be the day the land allotment is assigned an individual cadastral number.
Methods of carrying out the procedure
If a complete package of the above documents has been collected, cadastral registration of the property is carried out. Rosreestr defines 3 ways to apply:
- personally;
- by post;
- through the Internet.
In the second case, the signature of the applicant must be certified by a notary. The same applies to online applications, that is, confirmation of an electronic signature occurs.
The registration process is quite simple and straightforward. The main thing is to timely and fully collect all the necessary documentation.
