However, due to the fact that the cadastral passport is valid only for five years, there are situations when it is necessary to update it. Reconstruction or physical deterioration of a real estate property can be attributed to this category, because according to the legislation, the owner is obliged to independently introduce changes in the technical condition. The preparation of technical passports is carried out by a special state institution - the technical control bureau. There is a similar organization in every region of the country. Its task is the technical accounting and control of all real estate. At the same time, depending on what type of property the property is assigned to, the following data sheets are prepared:

  1. On the building.
  2. To the facilities.
  3. On the premises.
  4. For construction in progress.

As a rule, when it comes to housing, it is compiled either during the initial inventory, which occurs in the case of the construction of new houses, or during a secondary or unscheduled inventory. It reflects all changes made to capital construction (changes in utilities, reconstruction, redevelopment). All this must be agreed with the BTI and can only be carried out with its permission.

In this case, a statement is written in which the owner indicates the purpose of obtaining the document. When submitting an application, in addition to a passport, it is required to provide documents for the apartment: a certificate of ownership, as well as, depending on the situation, a certificate from a notary at the time of inheritance, a request from the Department of Architecture and Urban Planning when making redevelopment, a pledge agreement if the property is executed as collateral. This list is not finite. In different situations, additional documents may be required. After payment of the state fee (usually this can be done in all branches of Sberbank), these documents are accepted under signature by a BTI employee who appoints the day and time of departure of the technician.   • inventory value of real estate;
  • inventory number of the apartment;

  • mark on entering information about the object in the register of real estate.

Despite the fact that the term of the registration certificate for the apartment is not limited, it is better to make the technical changes that appear on time. In case of discrepancy between the data specified in the BTI and the actual, a fine of 1,500 rubles may be levied.

When purchasing real estate, a potential buyer should carefully study the documents for the apartment he is going to buy. This also applies to the data sheet. Studying it, you need to pay attention to the following information:

  1. An inventory of the property should be carried out no later than five years. Otherwise, a second examination may be required, since a technical passport for the apartment was submitted, the validity of which exceeds the time limits of the inventory, fixed in regulatory enactments.
  2. All redevelopment should be reflected in the plan of the apartment and legalized. Otherwise, the registration authority may refuse to register ownership. If the purchase and sale transaction still took place, the new owner risks subsequently paying a fine for illegal redevelopment or other changes made.

Since 2008, to carry out any real estate transactions, a cadastral, not a technical passport is needed. It is this document that confirms that the object is included in the cadastre and an individual number is assigned to it. However, since 2012, another one has been added to the list of documents allowing transactions with real estate - a technical plan, but at the same time the data sheet continues to exist safely as an independent document. This is because it is precisely his data that underlies the technical plan.

Moreover, the technical plan reflects one of the important points for registering real estate in the cadastral registry - the coordinates of the corners of the building or the location of the apartment on the floor. Thus, the object is attached to the land where it is located, or to the floor of the building. Documents that are the basis for the technical plan (project documentation, permission to operate the facility or technical passport) should be included as annexes in the form of certified copies. The compilation of this document is done by one person - a cadastral engineer. He is fully responsible for the accuracy of the information reflected in it, assuring the technical plan with his seal and signature.

Today, in order to be able to perform any actions with real estate, it is necessary to go through three stages:

  • order a technical passport from the bureau of technical inventory: in practice, this can take from 7 to 30 days;
  • order the technical plan of the object there: usually it is done within a month;
  • order a cadastral passport at the Rosreestr branch: this takes from 5 to 20 days.

Thus, the package of documents will be ready in about two months. Depending on the state of documents already existing, this process may take a little more or a little less time. But in any case, to speed up the process will have to significantly overpay. And if there is also no certificate of ownership, then these three stages are inevitable and are only the first steps. Therefore, when planning to sell your property, it is better to take care of the preparation of documents in advance.

Technical passport: is it needed?

According to the new federal law, which entered into force in 2008, the BTI technical passport has lost its legal force. Now for real estate transactions, you must have a cadastral passport, which is essentially an extract from the state cadastre, confirming information about the property. However, this document does not reflect all the information necessary for transactions or other actions with real estate. Even taking into account that the cadastral passport necessarily contains explication (layout of the apartment), it is still issued based on the information specified in the data sheet.

After the changes made in 2012, the question often arises: why is a technical passport needed at all? In order to understand this issue, you need to clearly understand the differences between the cadastral and technical passports. Indeed, in essence, they are the final documents of two different accounting systems. The situation is complicated by the fact that today in the state, along with cadastral registration, a technical inventory of capital construction facilities continues.

That is why most of the regulatory legal acts regulating this area remain valid and operate in parallel with the newly adopted laws on the state cadastre. In addition, the law states that the owner of the premises is obliged to independently monitor the technical condition and, if necessary, immediately make changes to the property related to its technical characteristics. It is much more practical to reflect them in the technical passport.
