All people are consumers of something. Each person at least once in his life purchased products that relate to complex technology.
If you have the necessary specifications and a warranty card, the thing is used for a period specified by the manufacturer or even longer.
If the product is not of the quality that the consumer expected, he has the right to return it or replace it with a similar one. The Law "On Protection of Consumer Rights" regulates these situations, and in the case of multi-technical products, you can refer to it.
However, what if the equipment (household or computer), as well as the components for it, are of good quality, but do not fit the person in any physical parameters? For example, they bought a washing machine, and it is larger in size than the opening for it.
On this account, there exists and has legal force such a procedure as the return of technically complex goods of good quality.
What are the norms?
First of all, you need to determine what is included in the list of products having a complex technical stuffing. Legislation provides a fairly accurate and detailed list.
In addition, there is another separate list of goods without any drawbacks that cannot be carried back within two weeks if the buyer changed his mind about using them or the item did not fit.
The general relationship between the buyer and seller, as well as the latter’s liability in case of non-compliance with the legal requirements of citizens, is contained in the law “On Protection of Consumer Rights”.
List of multi-technical products
The return of a technically sophisticated product of good quality begins with determining the conformity of the product to the list.
The list includes:
- Airplanes and helicopters with internal combustion engines (hereinafter - the internal combustion engine).
- Cars, motorcycles and the like, as well as tractors, walk-behind tractors and cultivators with ICE.
- Snowmobile transport with ICE.
- Sports vessels, including yachts, boats and boats, with internal combustion engine.
- Navigation equipment and wireless devices for domestic use, including satellite communications devices that have a touch screen and more than two functions.
- System units, stationary and laptop computers, including laptops (netbooks) and personal computer equipment.
- Inkjet or laser multifunction devices, as well as monitors with a digital base.
- TV, satellite TV, set-top boxes and digitally controlled projectors.
- Digital and optical photo and video cameras, lenses.
- Refrigeration and freezing equipment, dishwashers and washing machines, electric stoves, air conditioners, as well as electric water heaters.
List membership conditions
Thus, if the product is on this list, it is technically difficult. This list is exhaustive and not to be interpreted, that is, not discussed.
If a person has purchased a gas stove, it cannot be attributed to this list, since it is neither an electric stove nor a combination stove.
After the category of goods has been determined, it is necessary to observe the deadlines of 14 days. The day of purchase is not included.
Non-Refundable Products
Actually, the return of technically complex goods of appropriate quality within 14 days occurs only if such products are not available in the store. Then, by agreement, you can get back exactly the amount that was paid.
If you need an exchange, but there is no such product, you can wait until it appears in the seller’s warehouse.
Following this rule, it would be possible to exchange any product that did not suit the buyer on arrival home. For example, a wife bought a bouquet of flowers, but the second half did not like him; we went, presented a check and handed over the flowers back.
But fortunately for the seller, there is a document indicating the goods that under no circumstances can be exchanged or returned, even if the product did not fit in color, size, style and other criteria.
The products on the list include complex products, but are not limited to: automotive equipment, complex products with a warranty period - electronics, household computing and multiplying devices, photo and video equipment, telephone and fax machines, electric music devices, gas household equipment, plants, civilian weapons and cartridges for it, animals, as well as non-periodical publications, including those recorded on electronic media.
Other goods
In addition, the list contains other categories that do not apply to types of technically complex goods of good quality, but these rules apply to them.
For example, the buyer purchased a cable, but he did not fit. The wire is in the package, there is a check, 2 days have passed. The cable is included in the above lists, since it was released according to the meter (that is, when selling it, it was measured and cut). The buyer does not have the opportunity to contact the store.
According to the above categories, the return of a technically sophisticated product of good quality (Article 25 "On Protection of Consumer Rights") is real if 15 days have not passed and the product is not included in the list of things that a person cannot return and change.
Return to online store
Consumers who have not acquired the habit of shopping have an excellent opportunity to order and buy goods online. Here you must immediately make a reservation that the date of purchase will be considered the day of receipt, and not the date of conclusion of the contract with the store.
Many online businessmen guarantee that they will accept the goods back or exchange them if they did not fit or an error occurred while placing the order and the goods were sent with other characteristics.
For consumers, the fact of a purchase made remotely changes everything fundamentally. The lists that apply when purchasing products in a real store are not used. The time period when it is possible to return technically complex goods of appropriate quality to the online store starts on the day the order is received. The exchange (return) period itself is 7 days.
Such features are related to the fact that when choosing a product, the buyer cannot familiarize himself with it. Therefore, buyers of online stores have the right to refuse the selected product until receipt, as well as within 3 months if the seller has not provided in writing the terms and conditions for the return of goods of good quality.
If a person still wants to get his money back, he must send the goods back. In this case, the entire amount is returned, with the exception of the seller’s expenses for shipping products from the buyer.
Return by organization
The Law "On Protection of Consumer Rights" applies only to individuals. Return of technically complex goods of appropriate quality by a legal entity is not possible. The only option for a return or exchange is a competently drawn up contract in which such options for the development of events should be spelled out.
If these circumstances are indicated in the agreement, then all related actions (transportation, travel expenses, etc.) must be included.
Missed deadline
When a product is purchased and located at the consumer, it must be used for its intended purpose. If a person did not have a personal opportunity to use the purchase within two weeks, and then it turns out that the product is not suitable, you can no longer go to the store.The return of technically complex goods of good quality after 14 days is not legally possible.
Alternatives
In addition to these, there are other situations where a quality product can be returned without classification. These are options with an invalid contract, which becomes one due to the fault of the seller. If the contract clearly violates the rights of the consumer, or the seller does not provide information about the product at the first request of the buyer, the latter may refuse to conclude or execute the contract. In this case, the goods must be returned back to the outlet.
Violation of the terms of repair can also become the basis for refusal of products. And if the seller has not yet fulfilled the buyer's legal requirements within the time allotted for this, then he is obliged to pay the consumer an additional amount - 1% of the price of the product.
If a loan was issued upon purchase and a technically complex product of good quality is returned, the seller must return the full amount that the person has already managed to pay. The amount of money to be returned is calculated from the payment schedule that is provided to the buyer by the bank.
