Pensions working pensioners - a fairly relevant and discussed topic among working citizens of advanced age. In Russia, women retire upon reaching 55 years, and men - 60 years of age. But not all people at this age are at home, many of them have a desire to stay at their official job, and some are looking for additional income. In this article, we will just talk about what legal framework governs pensions for working pensioners.
So, according to the law, the elderly are divided into three categories:
- military pensioners;
- persons with disabilities receiving a pension;
- people who have reached retirement age.
Many elderly people are interested in the size of pensions and benefits. This question is especially interesting for those elderly people who decided to continue their work.
Pension in Russia
According to the law, people upon reaching retirement age have the right to continue their work and may receive a pension. But it is known that the Ministry of Labor of the Russian Federation put forward a proposal to reduce the size of pensions for working pensioners. This proposal was not accepted, as in this way pensioners would lose their pension. It is known that officials proposed that older workers abandon their seniority in exchange for an increased pension in the future. This proposal was also rejected. Here is such a reform for working retirees has been proposed.
The state decided not to deprive pensioners of pensioners who work. On the contrary, officials decided to stimulate older workers. So, recently, the State Duma was discussing such a topic as raising pensions for working pensioners. Officials promised an increased pension in exchange for an increase in seniority. In order to receive an increased pension, a pensioner needs to work at least 30-40 years. If a pensioner refuses to continue his seniority and goes on a well-deserved rest, he will not receive an increased pension. In other words, with this innovation, the state encourages pensioners not to go on vacation, but to increase their working experience.
The rights of pensioners who are still working
After a Russian citizen reaches his retirement age, he needs to contact the Pension Fund, where the amount of the pension will be assigned.
According to statistics, many people who have reached retirement age continue to work at their official place of work. But not all pensioners know the legal statistics and therefore can be deceived by their employer.
Many employers of retirement age employees offer to conclude a fixed-term employment contract, which, as a rule, is illegal.
An employer may conclude with a working pensioner:
- An employment contract that has an indefinite period.
- A fixed-term contract, which will be agreed by the two parties and will be legal.
- The contract, which is civil in nature. When signing this type of contract, the employer must warn the pensioner that his sick leave and leave will not be paid.
Pensioners, unlike disabled people and pregnant women, do not have many privileges, therefore, upon reaching retirement age, the employer has every right to dismiss them.
If the dismissal has occurred, the pensioner should know that he has no right to work for two weeks.There are times when employees who have reached retirement age ask the employer for part-time work. If the employer refused, then this refusal is legal, since pensioners do not belong to the category of people who are entitled to part-time work.
If the employer decided to leave the pensioner at work, he is entitled to an additional unpaid leave for 2 weeks.
Upon reaching the retirement age by the decision of the employer, he may be transferred to another position.
Recalculation of pensions
All working pensioners are eligible for benefits.
All employees of retirement age have bonuses every month, and the size of their pension changes with the size of the subsistence level. Pensioners who work in the educational sector receive a scientific pension, which averages 80% of the salary.
Existing benefits for senior citizens
All pensioners are eligible for tax benefits. They are exempted from paying building tax, regardless of how much a pensioner owns construction objects.
For pensioners who have not been working since 2010, there are special benefits that help to achieve a living wage.
In order to receive benefits and co-payments, people who have reached retirement age must submit a certain package of documents to the social security department of the person at the place of residence.
Social allowances for non-working pensioners
All pensioners have additional social support, which is funded by regional budgets.
All people who have reached retirement age have the right to:
- for preferential travel by public transport, except for a fixed-route taxi;
- for free dental treatment, namely the installation of prostheses.
For non-working pensioners there is an opportunity to get a ticket to sanatorium-resort treatment through social human rights protection bodies.
Families that consist solely of retirees and single retirees are entitled to a monthly monetary compensation to pay for urban communications. They also exempt from the payment of services for the export of solid waste.
Pensioners who have been assigned the status of a veteran of labor are entitled to additional benefits. This category should include:
- people who began working during the Great Patriotic War before reaching the age of 18;
- people who have a certificate of a veteran of labor;
- people who are awarded with medals and orders and have honorary titles of the times of the USSR.
Benefits for veterans mainly determine the regions. In most cases, these are discounts on utility bills and free use of public transport.
Recalculation of pensions for working citizens
There are three options for recalculating pensions for working retirees.
Option number 1. Recalculation is carried out according to earnings and seniority for 60 calendar working months until July 1, 2000. This recalculation will be carried out using the average wage indicator, which was taken into account when assigning a pension.
Option number 2. Recalculation will be carried out taking into account salary after the insurance period after July 1, 2000. With this option, the average wage indicator will also be taken into account.
Option number 3. Recalculation of the pension will be carried out only taking into account the length of service.
Each working pensioner has the right to contact the department in writing to receive information on the recalculation of pensions.
