Curfew is the time at which citizens are prohibited from visiting public places without permission established by law. As a rule, it is introduced in a period dangerous for society or in wartime. It is aimed at reducing the potential victims of dangerous crimes and malicious acts. Today, curfew in Russia is valid for persons under the age of 18.
"Nonsense" time
To ensure the safety of children and adolescents, as well as reduce crime against minors, curfew is provided for by the legislation of the Russian Federation. At the age of 16 and under 18, it is allowed to be in public places no later than 23 hours, children under 16 must be at home at 10 pm.
Night walks are only allowed when accompanied by a parent or other person who has come of age. How much is the curfew? The law establishes the extension of restrictions on the free movement of adolescents in night time until 6 a.m. Local authorities have the right to reduce this time.
Legislation
Curfew orders are governed by the Family Code and the Constitution of the Russian Federation. Since 2009, the Federal Law On Basic Guarantees children's rights in the Russian Federation " amendments have been made that determine the rules for minors in public places at night. Children under 7 years old should not be outside the house without an adult at any time.
How much is the curfew for minors? Persons under the age of 18 should return to their parents before 22 hours. Each subject of the Russian Federation independently establishes prohibited places to visit in accordance with local regulations and the criminal environment. In addition, local governments can reduce restrictions at night, focusing on the climatic and seasonal conditions of the area and the age of the people to whom the law applies.
Punishment of violators
In the case of the capture of a minor, the police take a number of standard actions - they establish the identity of the child, address, contact phone number, collect information about parents or other responsible persons. If it is not possible to find adults, the teenager is sent to a specialized institution.
Punishment is imposed on adults who irresponsibly letting the child go at the wrong time. For an administrative offense, a fine of 100 rubles to 5,000 is envisaged. In the event of a repeated violation, the amount increases.
The state will have to pay money not only to the parents and guardians of the caught teenager. Persons who organized the event with the participation of children and who allowed them to be left unattended at night are also punished. The law did not bypass institutions that allow minors at night. Enterprises face a fine of 10 to 50 thousand rubles.
Forbidden time in the regions of the Russian Federation
Focusing on fundamental federal law, individual constituent entities of the Russian Federation independently establish time and age restrictions, the amount of monetary penalties for breaking the law.
St. Petersburg
On New Year's Eve, school graduations and official holidays, curfew is canceled here. At 16 years of age, adolescents, like younger schoolchildren, must not walk at night until 10 p.m. during the study period (from September to May) and until 23 in the summer. From 16 to 18 years, teenagers have the right to be in public places until 11 o’clock in the evening. Penalties for parents start at a thousand rubles. In case of repeated violation, the amount increases to 5 thousand.
Komi Republic
There is a general procedure for complying with the law on forbidden time. Cash penalties for irresponsible adults are more loyal - from 100 to 500 rubles.
Ulyanovsk region
There has been a curfew in the region before. At age 16, children were not allowed to go outside without an adult. Since 2009, age restrictions have increased to 18 years.
Public Attitude to the Law
Not all citizens supported the decision of the government to introduce prohibited time for adolescents. According to authorities, frivolous parents do not want to pay fines for walking children at night. Are there any other reasons? The law was created to protect adolescents from negative factors affecting the mental, moral and even spiritual education of the young generation. The crime rate should decrease, because most of the bullying of minors occurs in the dark.
However, according to parents, the law does not take into account various nuances. Some high school students and first-year students earn extra money after class, often returning home by midnight. Other young citizens attend sports and creative events, which last until late. The prohibition of night traffic on the street includes the inability to travel by public transport, which makes it difficult for teenagers to return home. Apparently, the curfew law needs to be finalized in the light of such circumstances.
Prohibited time in other countries
Not only in Russia is curfew respected. At 16 years of age, adolescents and younger children must be accompanied by an adult at night in many civilized countries. The main goal of foreign legislation is the fight against youth crime and child alcoholism. In the US, in addition to the ban on night time, there is a day curfew. Pupils should not be outside the educational institution during school hours. In France, the president introduced time limits for the entire population due to the dangerous situation. After a series of terrorist attacks in the capital, citizens are limited in visiting crowded places and public events.
