In certain cases, they are obliged to coordinate their actions with executive regional bodies, the Ministry of Natural Resources, the Ministry of Energy and Industry, and other institutions. Legal status

Industrial lands are located beyond the boundaries of settlements. This is stated in Art. 87 ZK. At the same time, those parts of the territory that are inside the borders are recognized as settlement lands. This status is assigned regardless of the purpose for which they are used. So, the lands of industry, transport, communications are used according to the rules established for the territories of settlements. For example, it can be architectural and planning requirements. On the other hand, their use is determined in accordance with the rules governing the provision of the needs of industry, energy, transport, etc. In practice, the developed procedure for the exploitation of resources is necessarily coordinated with the administration of a city, village or other municipal entity.

Entities using industrial lands, communications, etc., are obliged to create security, sanitary-protective and other zones in their composition. Within their limits, a special regime of use is established. Sites that are part of such zones are not seized from entities that have legal rights to them. However, the rules limit their ability to dispose or conduct one or another activity. In this regard, the legislation provides the conditions under which the size of land plots are justified from an economic point of view when designing construction or other activities. The industrial lands for the most part are in the legal possession of the Russian Federation. State property, in particular, includes territories occupied by:

  1. Ways of communication.
  2. Energy systems, nuclear installations.
  3. Objects providing security, space activities, status and protection of the state border.

Industrial lands are transferred to enterprises to accommodate:

  2. Planning the costs of removal and subsequent storage of the fertile layer, reclamation and compensation of losses incurred by the previous user.

  3. In active karst zones, in areas of mudflows, landslides, avalanches that threaten exploitation and development, etc.
