In June 2011, Federal Law No. 138 was approved, according to which assistance is provided to large families. In particular, allotments for various purposes, including the construction of their own housing, should be allocated to this category of citizens. Moreover, this right is granted not only to persons who are officially married, but also single fathers / mothers who have three or more children under the age of 18, including stepchildren, stepdaughters, adopted children. Let us further consider how this assistance is provided to large families.
General information
Large families are given land that is in municipal or state ownership. At the same time, the size of the allotment, the terms of provision, as well as its location are established by the territorial authorities of the subject of the Russian Federation. A plot of land for large families is provided in accordance with the rule that it should be at least 6-10 and not more than 15 acres. It should be said that not all regions provide allotment within the city.
Land for large families in Moscow and St. Petersburg
In these megacities there is no possibility of providing allotments within the city. Moreover, the adopted Law "On Land for Large Families" puzzled local authorities. The fact is that the territories of the megalopolises themselves are quite strongly built up. In this regard, the city authorities are unlikely to be able to allocate any sections.
State authorities believe that outside the megacities there are enough territories that are suitable for settlement. Thus, the question of the implementation of the adopted Law fell on the regional authorities. However, the latter are debating this issue. For example, local authorities of the Leningrad Region, on the contrary, believe that land for large families is sufficient in the city. Representatives of the authorities of the cultural capital itself are inclined to believe that the suburbs should be developed.
Land acquisition
Large families are provided with allotments subject to a number of conditions. In particular, if:
- in the care of parents / adoptive parents, three or more children;
- the family officially lives in one or another subject for at least five years;
- children are raised by two parents and their marriage is registered with the registry office;
- the family does not own another plot.
The indicated conditions may be changed in accordance with the regulatory acts of the region.
Where and with what documents to go?
In order to realize their right to receive land ownership for free, large families should contact the administration of the Moscow Region with a statement. Attached to it:
- copies of the marriage certificate (if the whole family), the birth certificate of minor children, parents' passports (or one);
- statement from the house. books or a certificate stating that family members are registered at the place of residence;
- a document from the authority of guardianship and custody that the parents were not deprived of their rights to children;
- certificate of family composition.
If there are adopted children, then, among other things, it is necessary to present copies of papers confirming this fact. Also from the authority of guardianship and guardianship you need to get a certificate stating that the adoption has not been canceled.
Decision
After the above documents are handed over to the local administration, the territorial authorities either register the large family, or refuse it. The decision is made on average within a month. But, for example, in the Ivanovo Region the applicants receive a response in three days. With a positive decision, a large family will receive a certain number.He will indicate a place in the general queue. The duration of the wait will depend on the characteristics of a particular region. As a general rule in force in the country, land to large families should be transferred no later than after 1 year.
Use of allotments
Land for large families is provided for various purposes. For example, as mentioned above, the allotment can be used for the construction of housing or a summer residence. Also on the site you can engage in gardening, horticulture, animal husbandry, conduct personal subsidiary or farming. A large family should independently choose the category of use.
Important point
You need to know that the plot can be provided to the family only once. You can apply only in the municipality in which the needy live. The allotment will also be highlighted there. Plots that will be obtained can be sold or used for construction. Regarding the issue of the allotment, normative acts do not provide for restrictions. If the allocated plot does not suit a large family for some reason, it may refuse it. But in this case, you will have to apply again and stand in line.
Refusals
Local authorities may not provide the site for several reasons. Among them:
- Change of residence - travel outside the municipality.
- Inaccuracy of information in the documents attached to the application.
- Change of citizenship by one of close relatives.
It should be said that in the regions the implementation of the adopted Law is carried out in different ways. However, the actions of local authorities should not contradict nomes.
Field implementation
In the Ivanovo region, local authorities adopted their own program for providing land to families in accordance with Federal Law No. 138. So, those with a third child after 2011 are given the opportunity to purchase a plot for free (with an area of 12 acres).
In the Vologda Oblast, amendments to the Law have been adopted, according to which 10 acres are allocated to large families. Developed its own order in the Ulyanovsk region. In this region, the program is implemented in several stages.
First, suitable sites for construction are selected. Next, a list of those in need who are entitled to receive a free allotment is completed. At the next stage, land is offered to citizens in order of priority. If it suits the applicants, then an appropriate contract is drawn up. This document will confirm the transfer of the site. In a number of regions, it was proposed to replace the allotment with money - 200,000 rubles. The conditions for the allocation of land, therefore, may vary significantly in certain entities.
Performance difficulties
During the first two years from the date of signing and entry into force of the Law, its implementation was extremely unsatisfactory. Allotments in need stood out with great difficulty. As a result, many have ceased to believe in the validity of the Law.
At a government meeting, Dmitry Medvedev rather bluntly expressed dissatisfaction with the process of implementing the program. The Chair noted that the amount in which the allocation of plots takes place differs significantly from the numbers provided for in a smaller direction. Medvedev noted that, in approving the program, the Government was based on the real state of affairs and, in accordance with this, set the volume of property that could be provided. In practice, the plots are unreasonably small, the allotment area does not correspond to the declared figures.
Medvedev posed the question very clearly to officials. He not only expressed dissatisfaction with the pace and quality of the implementation of the program. Medvedev also set the task for authorized persons to find the necessary resources and seriously begin to act in accordance with the provisions of the Law.Delay in execution gave rise to rather large lines. Reducing them will require more effort. Also, the situation in the Moscow and Leningrad regions is still not entirely clear. Allotments were undoubtedly allocated to some needy. However, the lines for obtaining land have not decreased significantly.
Medvedev at the meeting noted that he would take the process of implementing the program under his personal control. Authorized persons, therefore, will report to him for the results of the work done.
